Resolution - 8806RESOLUTION NO. 8806 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, RELATING TO THE VOLUNTARY RESTRICTION OF ACCESS TO SPRAY PAINT CANS AND MARKERS BY WEST COVINA BUSINESSES. WHEREAS, the City of West Covina and the West Covina Chamber of Commerce have joined forces to combat the war against graffiti; and WHEREAS, the amount of graffiti in the City of West Covina and surrounding communities has increased significantly over the past few years; and WHEREAS, the increased costs to remove graffiti has had a significant impact on the City, businesses and community as a whole; and WHEREAS, Penal Code Section 594.1 (a) and (b) states that it is a misdemeanor to sell aerosol containers of paint to people under eighteen (18) years of age, except for those of six ounces or less; and WHEREAS, Penal Code Section 594.1 (c) states that any retailer selling aerosol containers of paint of more than six ounces capable of defacing property shall post in a conspicuous place a sign stating "Any person who maliciously defaces real or personal property with paint is guilty of vandalism which is punishable by a fine, imprisonment or both," and WHEREAS, Penal Code Section 594.1 (e) states that it is unlawful for any person under the age of 18 years to possess an aerosol container of paint for the purpose of defacing property while on any public highway, street, alley, or way, or other public place, regardless of whether that person is or is not in any automobile, vehicle, or other conveyance. WHEREAS„ the spray paint cans and markers used in the crime of graffiti and other forms of vandalism are obtained from vendors who sell them; WHEREAS, a minor accompanied.by a parent or guardian who is supervising the use of the paint and/or markers may purchase these items. NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council of the City of West Covina, with the cooperation of the West Covina Chamber of Commerce, does hereby approve the voluntary restriction of access to spray paint cans and markers by businesses in West Covina in an effort to help combat the war against graffiti. SECTION 2. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 7th day of April , 0 1992.
