Resolution - 5986RESOLUTION NO. 5986 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFY- ING ENVIRONMENTAL IMPACT REPORT NO. 1979-2 FOR ZONE CHANGE NO. 542 - A CHANGE OF ZONE • FOR A CITY OWNED PARCEL.LOCATED ON THE SOUTHWEST CORNER OF AZUSA AND NORMA AVENUES (GARVEY AVENUE SOUTH) AS BEING IN CONFORMANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, AS AMENDED. THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, there was filed with the City of West Covina, veritied applications for approval for a change of zone on. that certain property generally described as follows: southerly one-half of Lots 181 and 182 of E. J. Baldwin's 5th Subdivision as shown on Map recorded in -Book 12, Pages 134 and 135 of Maps in the office of the County Recorder;.and WHEREAS, it was determined that said. project could have a potential adverse impact on the environment and, therefore, an Environmental Impact Report should be prepared covering said project; and WHEREAS, -a Draft Environmental Impact Report was pre- pared and completed in May, 1979; and WHEREAS, a copy of said Draft Environmental Impact Report was submitted to the following agencies for comment: South Coast Air Quality Management District Los Angeles County Flood-Control•,District L. A. County Regional Planning Dept. L. A. County Road Department L. A. Countv Sanitation District Southern California Edison Company Southern California Gas Company WHEREAS, the State Office of Planning and Research published in the California EIR Monitor, reference to said Draft Environmental Impact Report; and WHEREAS, Draft Environmental Impact Report 1979-2, after a thirty -day review period, was submitted to the Planning Commission with related comments for public hearing and Planning Commission review on July 5, 1979, and testimony on said Environmental Impact Report was reviewed by the Commission; and WHEREAS, after said hearings, the Planning Commission determined that the submitted Draft Environmental Impact Report No. 1979-2 and related comments have adequately discussed the • project setting, the project description, the environmental im- pacts, mitigating measures to be taken, unavoidable adverse impacts, alternatives to the project, irreversible changes, growth inducing impacts, short-term vs. long term impacts, and conformance with adopted General and Specific Plans and Policies; and WHEREAS, the Planning Commission on July 5, 1979, adopted Resolution No. 7079-2970 recommending that the City Council certify Environmental Impact Report No. 1979-2 as being adequate and in conformance with the State of California's and the City of West Covina's Environmental Impact Report Guidelines; and • WHEREAS, said Resolution,. Draft Environmental Impact Report, commentsand responses to comments pertaining to said Report, minutes of the Planning Commission hearings, and staff reports were forwarded to the City Council for.their review and public hearing; and WHEREAS, a duly advertised public.hearing was held before the City Council on July 23, 1979 to accept testimony; and WHEREAS, after the close of public testimony, the Council referred the project back to the Planning Commission for further study; and WHEREAS, the Planning Commission reported its findings back to the City Council for consideration at its meeting of August 27, 1979; and WHEREAS, any significant adverse impacts to the environ- ment by the project have been identified and appropriate mitiga- ting measures identified. NOW, THEREFORE, BE IT RESOLVED, that the Environmental Impact Report is hereby supplemented to include the minutes of the City Council meeting of July 23, 1979 and August 27, 1979, by • incorporation of a copy of said minutes in the Final Environmental Impact Report. BE IT FURTHER RESOLVED, that the City Council approve the Final Environmental Impact Report and certify said Environ- mental Impact Report which has been completed in accordance with the California Environmental Quality Act of 1970,.as amended, the California State Environmental Impact Report Guidelines; and the City of West Covina Environmental Impact Report Guidelines; and further, that the City Council has considered all public input and has reviewed and considered the information contained in the Environmental Impact Report consisting of: a. Draft Environmental Impact Report. b. Addenda to the Environmental Impact Report. i. Comments and replies from responding public agencies. ii. Minutes of the Planning Commission hearing of July 5, 1979. iii. Staff report to the Planning Commission dated August 15, 1979. • FINALLY RESOLVED, that the City Clerk shall certify to the adoption of this Resolution.
