Resolution - 5979RESOLUTION NO. 5979 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFY- ING ENVIRONMENTAL IMPACT REPORT NO. 1979-4 • FOR THE DOUBLE CUL-DE-SACING AND VACATION OF GIANO AND GEMINI STREETS, AS BEING IN CONFORMANCE WITH THE CALIFORNIA ENVIRON- MENTAL QUALITY ACT, AS AMENDED. THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of West Covina undertook a project to double cul-de-sac Giano and Gemini Streets within the City of West Covina; and WHEREAS, it was determined that said project could have a potential adverse impact on the environment and, therefore, an Environmental Impact Report should be -prepared covering said project; and WHEREAS, a notice of preparation was prepared and sent to the following agencies for response on April 17, 1979: Los Angeles County Road Department Rowland Unified School District WHEREAS, a Draft Environmental Impact Report 1979-4 • was prepared and completed in May, 1979; and WHEREAS, a copy of said Draft Environmental Impact Report was submitted to the following agencies for comment on May 25, 1979: South Coast Air Quality Management District L. A. County Flood Control District L.. A. County Regional Planning Dept. L. A. County Road Dept. L. A. County Sanitation District Southern California Edison Company Southern California Gas Company Rowland Unified School District City of Walnut Citv of West Covina Engineering Dept. City of West Covina Fire Dept. City of West Covina Police Dept. WHEREAS, a Notice of Completion was filed with the County Clerk of Los Angeles County and the State of California Resources Agency on May 25, 1979; and WHEREAS, copies of said Environmental Impact Report were available in the City of West Covina Planning Department and Los Angeles County Library, West Covina Branch, for review; and WHEREAS, all agencies and the public were given thirty (30) days to comment to the Draft Environmental Impact Report; and WHEREAS, a duly advertised public hearing was held before the Citv Council on said project and Draft Environmental Impact Report on July 23, 1979; and WHEREAS, the City Council received testimony at said hearing; and • WHEREAS, said hearing was continued and readvertised to August 13, 1979, to accept further testimony on said project and Draft Environmental Impact Report; and WHEREAS, the project as proposed would not have a significant adverse environmental impact and thus would not require any alterations thereto; and WHEREAS, this conclusion has been verified by sub- stantial evidence contained in the Draft Environmental Impact Report and its addenda. NOW, THEREFORE, BE IT RESOLVED: 1. That the Environmental Impact Report be supple- mented to include the minutes of.. City Council meetings of July 23, 1979 and August 13, 1979, by incorporation of a copy of said minutes in the final Environmental Impact Report. 2. That the City Council approve the final Environ- mental Impact Report and certify that said Environ- mental Impact Report has been completed in accord- ance with the California Environmental Quality Act of 1970 as amended, the California State • Environmental Impact Report Guidelines, and the City of West Covina Environmental Impact Report Guidelines; and, further that the City Council has considered all public input and has reviewed and considered the information contained in the Environmental.Impact Report consisting of: • A. Draft Environmental Impact Report. B. Addenda to the Draft Environmental Impact Report. i. Explanation of limitations on response to comments on the Draft Environmental Impact Report. ii. Comments and replies from responding public agencies. iii. Stopping distance calculations. iv. Speed zoning report dated May 14, 1979. V. Traffic generations study and map. vi. Reports pertaining to the use of different types of traffic control -devices., vi. School study areas. -2- viii.Petitions in .favor and opposition to the project. C. Letters and staff responses. i. Giano Parent Advisory Croup. Mr. & Mrs. Ed Cedargreen. iii. Staff responses to public comments .at the City Council meetings of July 23 and August 13, 1979. BE IT FURTHER RESOLVED that specific economic, social, and other considerations make any mitigating measures heretofore unfounded significant adverse impacts unfeasible.
