A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, DECLARING ITS I,NTENTION,TO VACATE
A CERTAIN PORTION OF PASS AND COVINA ROAD SUBJECT TO
THE RESERVATION AND EXCEPTION OF CERTAIN RIGHTS AND
EASEMENTS.
• The City Council of the City of West Covina does resolve
as follows:
SECTION 1. The City Council of the City of West Covina,
does hereby declare its intention to vacate a certain portion of
Pass and Covina Road in the City of West Covina as shown on a map
or plan on file in the office of the City Clerk to which reference
is made for further particulars, described as follows:
That portion of Pass and Covina Road, 60 feet in width,
in the City of West Covina, County of Los Angeles, State of
California, as shown on a map filed in Book 85, Pages 10,
11, and 12, Record of Surveys, in the Office of the County
Recorder of said County, described as follows:
Commencing at a point of intersection with the northerly
boundary of Lot 1 as shown on said map filed in Book 85,
Pages, 10, 11 and 12, and the westerly line of Lark Ellen
Avenue, 80.00 feet in width, as shown on a map of Tract
No. 24006, as per map recorded in Book 805, Pages 1 to 4
inclusive of Maps, in.said Recorder's Office; thence along
said northerly boundary of Lot 1, South 64040'49" West, a
distance of 450.85 feet to the easterly line of said Pass
and Covina Road as shown on said map filed in Book 85,
• Pages 10, 11, and 12; thence along said easterly line,
South 28001'49" East, a distance of 220.87 feet to the
TRUE POINT OF BEGINNING; thence continuing along said
easterly line South 28001'49" East, a distance of 289.62
feet to a point on a non -tangent curve concave easterly
with a radius of 1,040.00 feet, a radial to said point
bears South 83006'41" West; said curve also being the west-
erly line of said Lark Ellen Avenue; thence along said curve
through a central angle of 13011'23", a distance of 239.41
feet to the westerly line of said Pass and Covina Road;
thence along said last mentioned westerly line North 280
01'49" West, a distance of 671.16 feet to a point on a non -
tangent curve concave northeasterly with a radius of 333.00
feet, a radial to said point bears South 54016'23" West;
thence along said last mentioned curve through a central
angle of 28007'41" a distance of 163.48 feet to the TRUE
POINT OF BEGINNING.
RESERVING AND EXCEPTING ALSO from said vacation the perm-
anent easement and right at any time, or from time to time,
to construct, maintain, operate, replace, remove, and renew
sanitary sewers, and appurtenanct structures thereof and to
construct, maintain, operate, replace, remove, renew, and
enlarge lines of pipe, conduits, cables, wires, poles,
and other convenient structures, equipment and fixtures for
the operation of gas pipe lines, telegraphic and telephone
• lines, and for the transportation or distribution of elec-
tric energy and water lines, including access and the right
to keep the property free from inflammable materials, and
wood growth, and otherwise protect the same from all
hazards -in, upon, and over the street or part thereof
proposed to be vacated.
The City Council does hereby determine that the public conven-
ience and necessity require the reservation of the rights, ease-
ments, and rights -of -way enumberated above. These proceedings
for the vacation of said portion of Pass & Covina Road are taken
subject to such reservations and exceptions.
• SECTION 2. The City Council of the City of West Covina
does hereby elect to proceed to vacate the said portion of said
.street under the provisions of Part 3, Division 9 of the Streets
and Highways Code of the State of California.
SECTION 3. The hour of 8:00 P.M. on Monday, the 13th
day of August, 1979, is hereby fixed as the time and the Council
Chambers, in the City Hall at 1444 West Garvey Avenue South, West
Covina, is hereby fixed as the place for hearing all persons in-
terested in or objecting to the proposed vacation of said por-
tion of said street.
SECTION 4. Notices of Street Vacation shall be posted by
the Street Superintendent in the manner prescribed by Section
8322 of the Streets and Highways Code of the State of California.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution and shall cause the -same to be published within
fifteen days of its adoption in one regular issue of the West
Covina Tribune,a newspaper of general circulation, printed, pub-
lished, and circulated in the City of West Covina.
