RESOLUTION NO'. 5928
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, DECLARING ITS INTENTION
TO VACATE A CERTAIN PORTION..OF GIANO STREET SUBJECT
TO THE RESERVATION AND EXCEPTION OF -CERTAIN RIGHTS
AND EASEMENTS.
The City Council of the City of West Covina does resolve
as follows:
SECTION 1. The, City Council of the. City of West Covina,
does hereby declare its intention to vacate a certain portion
of Giano Street in the City of West -'Covina -as shown on a map
or plan on file, in the office of the City Clerk to which
reference is made for further particulars, described as follows:
That portion of Giano .Street, 60.00 feet wide, as shown
on Tract Map No. 31619, in the City of West Covina,
County of Los Angeles, State of California, per map
recorded in Book 890, Pages 85 through 89 inclusive
of maps on file in the office of the County Recorder
of said County, bounded as follows:
Bounded northerly by the following described line:
Beginning at a point of cusp of the intersection
of the easterly -line of said Giano Street .and the
southerly line of Lot 135 of.said Tract 31619, also
referred to as Arizona (private street), said being
on a 370.00 foot radius curve concave southeasterly
and a 15.00 foot.point of cusp.
Radius curve concave southerly, a radial line to said
point of cusp bears north 420 42' 34" west; thence
north 420 42'.34" west, along said radial line,
60.00 feet to the westerly line of said Giano Street;
bounded southerly by a line parallel with and 2:00.
feet southerly,measured at right..:angles,from the
above mentioned radial line bearing north 420 42' 34"
west.
RESERVING AND EXCEPTING ALSO from said vacation the
permanent easement and right at any time, or from
time to time, to construct, maintain, operate, re-
place, remove, and renew sanitary sewers, and appur-
tenant structures thereof and to construct, maintain,
operate, replace, remove,.renew, and enlarge lines
of pipe, conduits, cables, wires, poles, and other
convenient structures, equipment and fixtures for
the operation of gas pipe lines, telegraphic and
telephone lines, and for the transportation or dis-,
tribution of electric energy and water lines, in
cluding access and the right to keep the property
free from inflammable materials, and wood growth,
and otherwise protect the same from all hazards
in, upon, and over`the street or part thereof
proposed to be vacated. -
The City Council does hereby determine that the public con-
venience and necessity require the reservation.of the rights,
easements, and rights -of -way enumerated above. These pro-
ceedings for the vacation of'said portion of Giano Street
are taken subject to such reservations and.,exceptions.
SECTION 2. The City Council of the City of West' Covina
does hereby elect to proceed to vacate the.said portion of said street
under the provisions of Part 3, Division-9 of the Streets and
Highways Code of the State of California..
SECTION 3. The hour of 8:00 P.M. on Monday, the 9th day of
July, 1979, is hereby fixed as the time and the Council Chambers
in the City Hall at 1444 West Garvey Avenue South, West Covina, is
hereby fixed as the place for hearing all persons interested in or
objecting to the proposed vacation of said portion of said street.
SECTION 4. Notices of Street Vacation shall be posted by
the Street Superintendent in the manner prescribed by Section 8322
of the Streets and Highways Code of the State of California.
SECTION 5. The City Clerk shall certify to the adoption of
this resolution.and shall cause the same to be published within
fifteen days of its adoption in one 'regular issue of the'
West Covina. Tribune, a newspaper of general circulation, printed,
published, and circulated in the City of.West Covina.
