A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, DECLARING ITS INTENTION TO..VACATE
A CERTAIN PORTION OF GEMINI STREET SUBJECT TO THE
RESERVATION AND EXCEPTION OF CERTAIN RIGHTS AND
® EASEMENTS.
The City Council of the City of West Covina does resolve
as follows:
SECTION 1. The City Council of the City of West Covina,
does hereby declare its intention to vacate a certain,portion of
Gemini Street in the City of West Covina as shown on a map or plan on
file in the office of the City Clerk to which reference is made for
further particulars, described as follows: .
That portion of Gemini Street, 60.00 feet wide in the
City of West Covina, County of Los Angeles, State of
California, as shown on Tract Map No. 28406 per map
recorded in Book 866 Pages 21, 22, 23 and 24 of maps
on file in the office of the County Recorder of said
County, bounded as follows:
Bounded westerly by a line that is parallel with and
60.00 feet easterly, measured at right angles, from
the westerly boundary line of said Tract 28406 and its
southerly prolongation; bounded4easterly by the follow-
ing described line: Beginning at the southeasterly
corner of Parcel 1 of Parcel Map,No.,7401 per map
recorded in Book 74 Pages 43 and .44 of. Parcel Maps of
official records of said county, said corner:being on
a curve concave northeasterly and having a radius of
45.00 feet, a radial line to said corner bears north
750 51' 22" west; thence southerly and southeasterly,
along said curve through a center angle"of 1150 00''.
00" and a arc length of 90.32 feet to a radial line
that bears south 100 51' 22" east; thencesoutherly,
along last mentioned radial line, to the southerly
line of said Gemini Street.
RESERVING AND EXCEPTING ALSO from said vacation the
permanent easement and right at any time, or from
time to time, to construct, maintain, operate, re-
place, remove, and renew sanitary sewers, and appur-
tenant structures thereof and to construct, maintain
operate, replace, remove, renew, and enlarge lines
of pipe, conduits, cables, wires, poles, and other
convenient structures, equipment and fixtures for
the operation of gas pipe lines, telegraphic and
telephone lines, and for the transportation -or
distribution of electric energy and water lines,
including access and the right to keep the
property free from inflammable materials, and
wood growth, and otherwise protect the same from
all hazards in, upon, and over the street or part
• thereof proposed to be vacated.
The City Council does hereby determine that the public conven-
ience and necessity require the reservation of the rights, ease-
ments, and rights -of -way enumerated above. These proceedings
for the vacation of said portion of Gemini Street are taken
subject to such reservations and exceptions.
SECTION 2. The'City Council of the.City`of West Covina
does hereby elect to proceed to vacate.th:e'said portion of said
street under the provisions of Part 3,. Division.9 of the Streets
and Highways Code of the State of California.
SECTION 3. The hour of 8:00 P.M -..on Monday, the 9th day
of July, 1979, is hereby fixed as the time and the Council
Chambers, in the City Hall at 1444 West Garvey Avenue South, West
Covina, is -hereby fixed as the place for hearing all persons in-
terested in or objecting to the proposed,vacation of said por-
tion of said street.
SECTION 4. Notices of.Street Vacation shall be posted by
the Street Superintendent in the manner prescribed by Section
8322 of the Streets and Highways Code of the State of California.
SECTION 5. The City Clerk shall certify to the adoption,of
this resolution and shall cause the same to be published.within
fifteen_ days of its adoption in one regular issue of the
West Covina. Tribune, a _newspaper of general circulation,
printed, published, and circulated in the City of West Covina.
