Resolution - 5878RESOLUTION NO. 5878 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ESTABLISHING THE CONFIDENTIAL/ EXEMPT SERVICE AND FIXING SUCH POSITIONS AND MENDING SECTION VII OF RESOLUTION NO. 1277 RELATING TO THE . LIST OF AUTHORIZED POSITIONS. WHEREAS, in the organizational structure of the City certain positions in City's service carry responsibilities not normally inherent in other City positions and such responsibilities include having access to budgetary, financial and other confidential information and decisions of City management affecting employer -employee relations; and WHEREAS, it is, therefore, desirable to establish and define a core of Confidential positions; and WHEREAS, as a result of many discussions by members of staff and with the City Council it has been found desirable to define and designate these Confidential positions, and the compensation and benefits to be derived by such position; and' WHEREAS, the City has, pursuant to Government Code, Section 3500 et seq, duly notified the respective employee organization affected and no adverse comments were registered with the City; and NOW, THEREFORE, the City Council of the City of West Covina does resolve; SECTION 1. That hereby is established a group of exempt service positions commonly referred to as Confidential. • SECTION 2. Confidential positions shall be those classifications in City departments that by virtue of their working relationship to department heads or other management personnel, have access to, knowledge of, or partici- pate in the gathering of confidential information concerning the City's financial, budgetary, or employer -employee relations. SECTION 3. Confidential personnel may not represent other employees or employee organizations in negotiations concerning wages, hours and other terms and conditions of employment. SECTION 4. Confidential positions are herein designated by their assignment to the salary key DHR-E ($770 to $1,385 monthly) and Section VII (Authorized Position List) of Resolution No. 1277 or when listed in Section 5 or Section 6 of this resolution; and the incumbents in such positions shall compose the City's Confidential service and thereby be entitled to the benefit package provided for in Section 7 of this resolution. SECTION 5. -The following positions currently in the City's Exempt service are hereby also designated as Confidential: 1. Administrative Analyst I 2. Administrative Analyst II • 3. Administrative Clerk 4. Department Aide 5. Executive Secretary U • SECTION 6. The following positions currently in the City's Classified service and designated as Confidential -and Exempt: 1. Secretary 2. Department Secretary SECTION 7. BENEFITS FOR CONFIDENTIAL SERVICE A Confidential employee benefit package, in addition to salary, will be provided to each Confidential employee (except Administrative Analyst I) whose position is listed in Section 5 and'6,herein. a. ADMINISTRATIVE LEAVE Up to a maximum of five days leave may be awarded to employees in the Confidential service based upon extra hours contributed by the employee as evaluated and approved by the respective department head,consistent with the policy governing the "Administrative Leave" program. b. DEFERRED COMPENSATION. A $25 per month allotment to each employee which may be contri- buted towards employee health insurance premiums or a designated deferred compen- sation program. salary. C. LIFE INSURANCE Term life insurance in an amount equal to one year's gross annual SECTION 8. ADMINISTRATIVE ANALYST I The position of Administrative Analyst I will remain on the classified salary step plan and will receive the regular benefits accruing to City employees in the classified service except that employees in this classification will also be eligible for Administrative Leave pursuant to Section 7(a) herein. SECTION 9. The effective date of this resolution is April 1, 1979. SECTION 10. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 12t hday of March , 1979.
