RESOLUTION NO. 5864
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AUTHORIZING THE CITY MANAGER.TO FILE
THE NECESSARY APPLICATION WITH THE DEPARTMENT
OF INDUSTRIAL RELATIONS TO SELF -INSURE FOR
WORKERS COMPENSATION PURPOSES AND AMENDING
RESOLUTION NO. 5762.
WHEREAS, the City is required to make an
application to self -insure for Workers Compensation purposes;
and
WHEREAS, said application form prepared by the
Department of Industrial Relations requires an application
signed by a representative of the City that is authorized
to sign such application by a Resolution of the governing
body of the City; and
WHEREAS, said application further purports to
require that the applicant agree to submitting to regula-
tions of the Director of Industrial Relations; and
WHEREAS, the City Council is willing to submit to
such regulations as the Director of Industrial Relations is
empowered by statute to impose, but is unwilling to agree
to submit to any regulations that the Director of Industrial
Relations is not empowered by statute to impose; and
WHEREAS, it is necessary that an additional section
be incorporated into Resolution No. 5762 of the City of
West Covina establishing those persons authorized to act for
the City in those matters relating to Workers Compensation;
NOW,.THEREFORE, THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Mayor be, and hereby is
authorized to file with the State Department of Industrial
Relations an application to self -insure for Workers Compensa-
tion purposes, and to sign the same on behalf of the City,
and to agree therein to be bound by the statutory authority
of the Director of Industrial Relations, to prescribe the
rules and regulations upon which the Certificate of Consent
to Self -Insure shall be granted, and to agree.to accept any
permit subject to the statutory authority of the Director of
Industrial Relations.
SECTION 2. Section 3 of the Resolution No. 5762 is
hereby amended to read in its entirety as Section 4. In
addition thereto, Resolution No. 5762 is hereby amended by the
addition thereto of a new Section 3 to read as'follows:
"SECTION 3. The Risk Management
Coordinator shall serve under the direction
• of the City Manager and shall be authorized
to act for the City of West Covina in those
matters relating to Workers Compensation."
SECTION 3. A certified copy of this Resolution
and Resolution No. 5762 shall be attached to any application
for consent to self -insure filed with the Department of
Industrial Relations.
SECTION 4. The City Clerk shall certify to the
adoption of this Resolution..
