Resolution - 5853RESOLUTION NO. 5853 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING PRECISE PLAN OF DESIGN NO. 724. (M. J. Brock & Sons., Inc.) • THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: WHEREAS, there was filed with the City of West Covina a verified application on forms prescribed in Section 10502 of the West Covina Municipal Code, requesting approval of a precise plan of design on that certain property generally described as follows: a 50-acre portion of Lot 116 of Tract No. 930 as per map recorded in Book 17, Pages 38 and 39 of Maps in the Office of the County Recorder; and WHEREAS, the Planning Commission, upon giving the re- quired notice did on the 6th day of December, 1978, conduct a duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, studies and investigations made by the Commission and in its behalf revealed the following facts: 1. The applicant requested approval of a precise plan of design for the construction of a 200-unit condominium complex on a 50-acre parcel at the above location. 2. The subject precise plan meets or exceeds all develop- ment standards of the MF-8 (Condominium) Zone, Area District I.- 3. Findings for approval of a precise plan: a. In reviewing the precise plan, it has been found that consideration has been given and restrictions imposed .to the extent necessary to permit the same degree of enjoyment of the subject property, but subject to the same degree of protection of adjoin- ing properties, as would be accorded in normal cir- cumstances by the standard restrictions imposed by the Municipal Code. b. The proposed precise plan will not depreciate prop- erty values in the vicinity or interfere with the use or enjoyment of property in the vicinity or endanger the public peace, health, safety or general welfare. 4. The subject precise plan has been filed in conjunction with Zone Change No. 531, Tentative Tract No. 35930, and General Plan Amendment No. 1978-1. It has been deter- mined that this project may have significant impacts on the environment, and an Environmental Impact Report has been prepared in compliance with the California Environ- mental Quality Act of 1970 (CEQA); and WHEREAS, the Planning Commission on December 6, 1978, adopted Resolution No. 12-78-2921 recommending that the City Council approve Precise Plan of Design No. 724, subject to cer- tain conditions contained therein; and WHEREAS, the City Council upon giving the required • notice did on the 22nd day of January, 1979, conduct a duly advertised public hearing to consider said application; and WHEREAS, testimony and staff reports received at said hearings affirmed the findings made by the Planning Commission during its -hearings of December 6, 1978, and set forth in this resolution. NOW, THEREFORE, BE IT RESOLVED THAT: a. Pursuant to the findings made in Planning Commission Resolution No. 12-78-2921 and re -affirmed by this Council; and those findings contained in the City Council Resolution No. 5851 certifying the Environ- mental Impact Report, and the findings of staff reports dated December 6, 1978, for said Precise Plan, Zone Change No. 531, Tentative Tract Map No. 35930, which are hereby incorporated herein, the City Council does hereby approve Precise Plan No. 724. b. The physical development of the property encompassed by Precise Plan No. 724 shall conform to the follow- ing conditions which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the Planning Director, and the violation of any of which shall be grounds for revocation of said Precise Plan. Conditions of approval: 1. Comply with Study Plan "A", dated December 6, 1978. 2. Comply with Exhibits 1, 2, 3, 4 and 5 (Elevations). 3. Project shall comply with all requirements of the MF-8 Zone. 4. All utilities shall be installed underground. 5. Five and one-half foot high trash enclosures shall be provided pursuant to Section 10807.16. 6. A landscaping plan, including type, size and quantity of plant materials and a fully automatic sprinkling system, shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. 7. Applicant shall provide 176 parkway trees and bubblers • at approximately 40-foot intervals on center. 8. A park fee shall be paid to the City of West Covina prior to the issuance of building permits, pursuant to Section 9134 of the Municipal Code. -2- CJ 0 • 9. A fence not less than six feet in height shall be in- stalled along the entire east property line adjacent to Galster Park. Fence material to be at least chain link, with emergency vehicular access at intervals to meet Fire Department requirement. 10. The developer shall draft a Prospective Homebuyers Awareness Package (PHAP) pursuant to section 9135 of the Municipal Code. 11. It shall be the responsibility of the developer to explain in said PHAP any impacts whether affirmative or negative on the development from adjacent areas. 12. Said PHAP shall also recommend to prospective buyers that they investigate to their own satisfaction the impacts of the BKK Sanitary Landfill.. 13. Engineering Department Requirements: a. Applicant to comply with all conditions contained in Planning Commission Resolution No. 567. b. Sanitary sewers shall be provided. C. The required street improvements shall include those portions of Aroma, Donna Beth and Fairgrove contiguous to subject property. d. The required street dedications shall include those portions of Aroma, Donna Beth and Fairgrove contigu- ous to subject property. e. The access rights to subject property from Fairgrove Avenue shall be dedicated to the City. f. 9-foot wide sidewalks (with trees in tree wells) shall be constructed along Aroma, Donna Beth and Fairgrove adjacent to curb. g. Adequate provision shall be made for acceptance and disposal of surface drainage entering the property from adjacent areas. h. Parking lot and driveway improvements on private property shall comply with Planning Commission Resolution No. 2513 and be constructed to the City of West Covina Standards. i. Applicant shall construct water service facilities to the satisfaction of the City Engineer in accord- ance.with City ordinances. j. Prior to issuance of a building permit and/or approv- al of a final map, the applicant shall satisfy all of the following requirements: i. A final grading and drainage plan showing exist- ing and proposed elevations and drainage struc- tures (and showing existing and proposed on -site and off -site improvements) shall be submitted to and approved by the Planning, Building and Engineering Departments. -3- ii. Arrangements for the installation of street lights with underground wiring shall be made with Southern California Edison Company. At the time of installation, the applicant shall provide the necessary trenching and backfill. • iii. A parking lot lighting plan showing electrolier types (in conformance with City Standard Drawing T-33) and locations, average illumination levels, points of minimum illumination and photometric data as requested shall be submitted to and approved by the City Engineer and Planning Director. iv. An itemized cost estimate for all on -site and off -site improvements to be constructed (except buildings) shall be submitted to Engineering Department for approval. Based upon the approved cost estimates, required fees shall be paid and improvement securities shall be posted prior to final approval of the plans. k. The proposed subdivision shall conform to Article IX, Chapter 1 - Subdivisions, of the West Covina Municipal Code. 1. Applicant shall be responsible for construction of Aroma Drive on City -owned land to join existing street including any necessary revisions to park entrance/ parking/fencing or other affected improvements. M. If at the time of construction of Fairgrove Avenue there are no extensions to the east or west, the • applicant shall construct barricades across Fair - grove immediately west and east of Aroma Drive. 14. Building Department Requirements: No requirements. 15. Fire Department Requirements: a. Steamer fire hydrants (22" x 4" outlets) - James Jones model 3700 or approved equal. Quantity and location subject to approval of the West Covina Fire Department. b.° Water system as specified. C. 300' spacing between hydrants. d. Fire hydrants on plan to be flushed and painted by contractor or developer before Fire Department acceptance. e. Both hydrant outlet openings shall form a 450 angle with curb face. • f. Center of hydrant head outlet openings to be 30" - 36" above finish grade. g. On -site water serviceable hydrants to be provided by developer before framing started. Hydrants to be pro- vided as development progresses supplied with water. -4- h. On hillside developments a sprinkler system with manual override shall be provided on all slopes over 15' in height. i. 35' turning radius for pumper. • j. 50' turning radius for Snorkel. 15' overhang from rear wheel to end of Snorkel basket. 25' drive standard. k. Minimum 25' access drives around commercial develop- ments. 1. Interior drives shall provide circulation around complex and vehicle access within 150' of any build- ing or portion thereof. M. Snorkel use on travelled areas needs 20 ton support. n. Where ladder access is necessary, will need adequate room to raise ladders. Please use following formula (approximate guideline under normal conditions): Height of building . 4. o. West Covina Building Department clearance form for building permit.- Note on form all requirements as authorized on Precise Plan or noted on final Planning Commission approval. p. Water mains and hydrants to be installed as per City of West Covina Water Department Standards or AWWA Standards. See C600, "AWWA-Standard for Installation of Cast Iron Water Mains," and AWWA Manual M17, • "Installation, Operation, and Maintenance of Fire Hydrants," and AWWA C503-75 "Wet Barrel Fire Hydrants." q. Water requirements are as specified. r. Minimum 8" mains - total looped system. 3,000 GPM required. S. Roofing materials shall be "Coppers" (metal lined wood shake) or tile. 16. Police Department Requirements: a. Provide security lighting. b. Provide "easy -to -read" addresses for each unit. FINALLY RESOLVED, that the City Clerk shall certify to the adoption of this resolution.
