RESOLUTION NO. 5757
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, WITHDRAWING ALL
THAT PORTION OR THAT PART. OF THE CITY OF WEST
COVINA CONTAINED WITHIN THE BOUNDARIES OF
COUNTY LIGHTING MAINTENANCE DISTRICT NO. 1744.
WHEREAS, County Lighting Maintenance District No. 1744
was heretofore formed by and is under the ;jurisdiction of the Board
of Supervisors of the County of Los Angeles under and pursuant to
the provisions of Chapter 26 of Part 3 of Division 7 of the Streets
and Highways Code of the State of California; and
WHEREAS, a. portion of said district is included within
the .bounda.ries of the City of West Covinaby rea.son of a.nnexa.tion;
and
WHEREAS, said portion contained within the boundaries
of the City of West Covina, shall continue to remain a. part of the
district for, all purposes, until a. copy of the Resolution adopted
by the City requesting exclusion of such territory from the District
is received by the Board of Supervisors; and
WHEREAS, the City of West Covina,desires to withdraw all
portions of said City located within the boundaries of County Lighting
Maintenance District No. 1744;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of West Covina as follows:
SECTION 1. Pursuant to Section 5853 of Cha.pter 26, Part 3,
• Division 7 of the Streets and Highways Code of the State of California,,
all that portion of the City of West Covina, loca.ted within the
boundaries of the County Lighting Maintenance District No. 1744 is
hereby withdrawn, and the Board of Supervisors is requested to exclude
sa.id territory from said District.
SECTION 2. The Board of Supervisors of the County of
Los Angeles is hereby requested to exclude the territory of the City
of West Covina, from said District., and to authorize the distribution
and disbursement of all property, funds and a.ssets of said District
in accordance with the terms and provisions of Chapter 26, Part 3,
Division 7 of the Streets and Highways Code of the State of California..
SECTION 3. The City Clerk shall certify to the a.doption
of this resolution and shall file a. certified copy thereof with the
Board of Supervisors of the County of Los Angeles.
