Resolution - 5719• follows: follows: RESOLUTION NO. 5719 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 5292 CLARIFYING THE CLASSIFICATION OF THE CITY'S BUSINESS LICENSE TAX RELATING TO EXHIBIT I, AND PROVIDING FOR THE EXEMPTION OF THE CITY FROM THE DISPOSAL FEE SCHEDULE. The City Council of the City of West Covina does resolve as SECTION 1. Exhibit I contained in Resolution 5292 is amended as "MAXIMUM RATES FOR WASTE DISPOSAL AT THE BKK COMPANY LANDFILL (WEST COVINA) SOLID WASTE Group.II and III Materials: Maximum rates for residential and commercial rubbish, demolition debris, yard trimmings and other Group II and III materials will be the same as those currently approved by the L. A. County Board of Supervisors for the neighboring Spadra and Puente Hills landfills operated by the County Sanitation Districts. Effective July 1, 1975, these rates are: Refuse $2.25 per ton Solid inert material $1.75 per ton Hard -to -handle bulky material $3.25 per ton Minimum charge $2.00 per load Group I (and "Special. Container") Materials: Maximum rates for such will normally be the same as for "hard -to - handle" materials shown above, but extra charges may be made where special handling or extraordinary burial or safety provisions are required. LIOUID AND SLUDGE WASTE Group II Materials (Bulk Delivery): $.04 per,gallon Group I Materials (Bulk Delivery): $.06 per gallon Delivery in Drums., Barrels or Other Containers: Maximum rates will be as above for bulk delivery of liquids plus extra charges for special container handling and burial requirements. ********** Special -Note: Above rate schedule does not include State taxes or fees which may be imposed, e.g., for hazardous waste disposal. The above rate schedule excludes City business license tax. City business license tax and State fees will be added to the above -shown rates for both solid and liquid waste, as applicable. The City shall be entitled to dispose of its own waste material at the landfill site and shall not be subject to the imposition of any disposal fees." Res. No. 5719 Page Two SECTION 2. Validity of Resolution. If any section, subsection, • sentence., clause, phrase or portion of this Resolution is for .any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have adopted this Resolution and each section, sub -section, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, phrases, or portions be declared invalid or unconsti- tutional. SECTION 3. The City Clerk shall certify to the adoption of this resolution. ADOPTED and APPROVED this 16th day of June 1978.
