Resolution - 5669RESOLUTION NO. 5669 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND . NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY IN FEE FOR PUBLIC STREET PURPOSES AND ALL USES APPURTENANT THERETO (West Covina Parkway at Virginia Avenue) . The City Council of the City of West Covina does hereby determine and resolve.as follows: SECTION I. The City Council of the City of West Covina has determined that the public health, safety and welfare requires the extension of West Covina Parkway into its intersection with Virginia Avenue. The extension of West Covina Parkway requires the acquisition by the City of a certain parcel of real property more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof. On April 10, 1978, after fifteen days written notice to the owner of the property described in Section 4 hereof; as it then appeared on the last equalized County Assessment roll, the City Council held a hearing and allowed the owner thereof a reasonable opportunity to appear and be heard on the following matters:,, a. That the public interest or necessity require • the project. b. That the project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury. C. That the property so to be acquired is necessary for the project. SECTION 2. The City Council of the City of West Covina does hereby find and determine and declare that the public interest, convenience and necessity require the acquisition by said City of the fee simple title in and to certain hereinafter described real property for public street and road purposes and,all uses appurtenant thereto with the right to enter upon such property and to construct thereon a public street and related improvements. The location of said right of way and the streete,;�etension project is planned in a manner which will be most compatible to the greatest public good and the least private injury. The taking of the interests in said property as above described is necessary to such use, and is authorized by Section 19 of Article I of the California Constitution, Section 37350.5 of the California Government Code, and Sections 1240.010 through 1240.050 of the California Code of Civil Procedure. Such acquisition of said property for public street and road purposes as aforesaid, • has been submitted to and reported upon to the West Covina City Council by the West Covina City Planning Commission as to conformity with the City's adopted General Plan pursuant to Section 65402 of the California Government Code. SECTION 3. The City Council of the City of West Covina does hereby declare that it is the intention of said City to acquire said property in its name in accordance with the provisions of the laws of the State of California with reference to condemnation procedures. • SECTION 4. The said real property hereinabove referred to, the acquisition of which is required by said public interest, convenience and necessity for the purposes set forth in Section 2 hereof, is located in the City of West Covina, County of Los Angeles, State of California, and is particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference and made a part hereof. SECTION 5. The City Attorney and the law firm of Burke, Williams and Sorensen are hereby authorized and directed to prepare, institute and prosecute in the name of the City of West Covina, such proceedings in the proper court having jurisdiction thereof, as may be necessary for the acquisition of said real property as is described in Section 4 hereof, including the right to enter upon the property described in said Exhibit "A" and to construct thereon the proposed project. Said counsel are also authorized and directed to obtain a necessary order of court granting to said City the right of immediate possession and occupancy of said property. SECTION 6. The City Clerk shall certify to the adoption of this resolution. Approved and adopted this loth day of April , 1978.
