A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF WEST COVINA REJECTING
• A PRECISE PLAN OF DESIGN (Precise
Plan No. 684, Rev. 1 - Franchise
Realty Interstate Corporation).
The City Council of the City of West Covina does hereby
resolve as follows:
SECTION 1. The City Council does hereby find and determine
that there was filed with the Planning Commission the application
of Franchise Realty Interstate Corporation requesting the approval
of a Precise Plan of Design for the construction of a 3344 square
foot drive-in restaurant facility on property in the Service -
Commercial zone, described as a 1.016 acre parcel, including por-
tions of Lot 8, Lot 29 Phillips Tract, and Lots 84, 85 and 290 of
Tract No. 16472 on file in the Office of the County Recorder of
Los Angeles County, all as more particularly described in Precise
Plan of Design Application No. 684, Rev. 1; that hearings thereon
were duly conducted by the Planning Commission and the Planning
Commission rejected the precise plan by its Resolution No. 12-77-
2805; that the rejection of the precise plan was appealed_to the City
Council and the City Council held a hearing thereon and proper and
legal notice of the hearing was duly given.
SECTION 2. The City Council hereby finds and determines
that the property described in Section 1 hereof is not adequate in
. size and shape to accommodate the proposed use of a drive-in rest-
aurant for the reason that a single driveway is proposed for the
entrance of vehicles to.the property and the exit of vehicles from
the property upon Azusa Avenue which would create at unacceptable
increase in traffic congestion in an area which is in close
proximity to the freeway on ramp.
SECTION 3. For.the reasons set forth in Section 2 hereof
and in Planning Commission Resolution No. 12-77-2805, Precise Plan
of Design No. 684, Rev. 1 is hereby rejected.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
