A RESOLUT-ION OF THE CITY.COUNCIL OF -THE
_ CITY OF -WEST COVINA GRANTING VARIANCE
NO. 747 (Osborne/Maurer).
The City Council of the -City of West -.Covina does resolve
as follows:._ -
SECTION 1. It is hereby found and determined that the
application of Robert E. Osborne -and Robert E. Maurer, Skateland
USA, for a variance from certain -parking standards and a variance
for a detached off=site sign in order. to develop a 2.4-acre parcel
-of land described as:
A portion of Lot 166 of E. J. Baldwin's
Fourth Subdivision of apart of Rancho.
-La Puente, in the City of West Covina,
-..County of Los Angeles, State of California,
as per -map recorded in Book 8, Page 186 of
maps, in the office of the County Recorder
of said county, a11 as more particularly
described in Variance -Application No. 747,
was regularly filed with the Planning Department.
SECTION.2. Hearings thereon.were duly.held by the Planning
• Commission after legal notice thereof, that -the Planning Commission
granted said variance by its -resolution No. 11-77-2792, that
said action,was-appealed;to.the City Council and the -City Council
held.a hearing thereon after legal notice thereof.
SECTION 3. -It is hereby found by the City Council.that:
X. I. Findings -for variance to reduce parking:
(1) As shown by an actual staff..survey,there are
circumstances applicable to`;a roller skating
:rink that are not applicable to other properties
or classes of use in the -same vicinity' (West
Covina and Glendora): There are.no roller
skating rinks. `in the ' S-C. Zone. The West -Covina
ice skating rink'is in an N-C (Neighborhood
Commercial) Zone. The'West_ Cov na>roller
Skating rink -is -in the-M=1. (Manufacturing ) Zone.
(2) A�variance is necessary for -the preservation of -
prop property right to develop :the property and
provide only the -amount of parking required for.
the use.
(3) Based on.actual *statistics and observation, the
granting of a.varance to reduce the number of
• parking spaces required will not be materially
:detrimental to the. public welfare, or inj.urious
to the property or improvements in the vicinity
of the subject --property.
-(4) The granting of such variance will be consistent
with -the adopted General Plan of the City -of
West Covina.
B. Findings for variance for off -site free standing sign:
I) Exceptional circumstances exist in that the bowling
alley and -skating -rink may be considered to be an
integrated recreational.center with.mutually
• accessible parking.
(2) 'The..granting of the''variance will not be materially
detrimental to the public welfare or injurious to
.any .property or improvement in.the.vicinity. -On
the -contrary, by placing the sign on Glendora
Avenue., the parking area_will appear less cluttered'
allowing a.vis.ually more pleasing view from
-Service Avenue.
(3) The granting of this Variance will not adversely
affect .the General -Plan.
SECTION'3.' A variance is hereby granted as applied for in
Variance Application -No. 747. It is .granted upon the following
conditions, the violation of an.y one of.which-shall be -grounds for
the revocation of.the variance by*the Planning Commission or the
City Council.- This variance shall not_.be effective for any purpose
until the owner of the property or his duly authorized representative
has filed in the office of the Planning Department an affidavit
stating that he is.aware of.and.accepts.'all of the following condi-'
tions.of this variance:
A. Comply.with.Study Plan "A", dated October 19, 1977,
including the additional.58 spaces for parking, making
a.total.of 150 parking spaces on.site.
• B. An 86 square foot per 'face offsite detached sign
shall be permitted, at the'northwest.corner of Glendora
and Service Avenues.
SECTION 4. An Environmental -Impact Report for the project
-has been certified in connection with the application for the,
variance and precise'plan upon the same parcel and -has been found
to have been prepared in accordance with the requirements of the
California Environmental Quality Act of'1970 and the State Guide-
lines adopted pursuant thereto.
SECTION 5. The. City Clerk shall certify to the. adoption
of this resolution.
