Resolution - 5590• •. RESOLUTION NO. 5590 A RESOLUTION OF THE CITY COUNCIL OF -THE CITY OF WEST COVINA, CALIFORNIA, APPROVING TENTATIVE TRACT NO. 33553 IN. THE PCD-1 ZONE (Hollenbeck Development Company, Inc.). WHEREAS, there was filed with the Planning Commission a verified. application on the forms'prescribed for the physical development of that certain property generally described as follows: a 63!;.3 acre parcel of land located at the northeast corner of Nogales Street and La Puente Road for an eleven (11) parcel sul5division. WHEREAS, the Planning Commission. upon giving the required notice did on the 20th day'ofJuly, 1977, conduct a -duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, the Planning Commission, based on evidence presented as a result of studies and investigations, found that .Tentative Tract No. 33553 met all required findings for approval and adopted Resolution No.7-77-2765 approving Tentative Tract No. 33553 and certifying the Environmental Impact therefore;. and WHEREAS, an appeal of that'Planning Commission decision was filed with the City Clerk of the City of West-Covina.requesting a hearing before the City Council of the City of West Covina; and. WHEREAS, the City Counci I, upon giving the required notice, did on the 12th day of September, 1977, conduct a duly advertised public hearing as prescribed by law to consider said appeal; and. WHEREAS, with the consent of.the applicant, the determination of the appeal was continued to October 10, 1977atwhich time the Environmental Impact Report for the project was certified and Tentative Tract No. 33553 was rerefe_ rred to the Planning Commission for further;"cons ideration; and WHEREAS, on November 28, 1977, after notice given as required by law, held a public hearing to consider the recommendations of the Planning Commission with refer- ence to said tract map- and WHEREAS, studies and investigations made by this Council and in its behalf reveal the following facts: 1. The proposed map is consistent with applicable general and specific plans in that the division of the land does not modify or effect the density permitted on the area. The . map does provide for a local public street through the development to facilitate traffic generated by the,proposed development.. The map in not modifying the density approved by the Master Plan for the area. is, therefore, consistent with the adopted City General Plan. It should be noted that the Tentative Tract map is not the catalyst to development but rather approval of the Development. Plan 22 (Study Plan B). The map does, however, provide a clear delineation of the commercial and residential areas. j, f .2. The design or improvement df the proposed -subdivision is consistent with applicable general and specific I" lans in that while general and specific -plans do not specify Ip the`number-of parcels into which a multiple residential area must be divided, and while such division does not -impact density since it is based on area, the public streets shown within ),the tract map are, consistent with .the goals and objectives of the Woodside Master Plan and the City's General Plan to create safe efficient circu- • lation. systems (see 6) •to -provide ease of access in the most efficient and effective manner. possible. I 3. The site is physically suitable for the proposed density of the subdivision in that the creation of eleven Pots does not impact development in any manner. The eleven lots created by the subdivision all have access to public streets and none are land locked. C 4. The site is suitable ,for the proposed type. of development. In the case of multiple residential zoning ip the.City of West Covina the division of property does not in 1.and of itself determ+ire density, but rather the -lot size.. Since the project involved covers the entire area zoned PCD-1 •25 DU/AC the division of land does not impact. the density. 5. The design of the subdivision will not be injurious to fish or wildlife because there are no fish or wildlife on the property in question.. r, - . N" 6. The design of the subdivision or the proposed improvements will not cause serious public health problems. 7. The design of the subdivision does not conflict with easements required by the public at large for access: through or use of, property within the proposed subdivision in that there are no easements existing through the area subdivided. NOW,'THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES RESOLVE AS FOLLOWS: 1. Pursuant to the above findings and those findings contained in Resolution No. 5562 certifying the Environmental Impact Report and those findings in the staff report dated July.25,. 1977, and supplements dated September 12, 1977-i.and October 10, 1977, for.said project Which.are-hereby incorporated herein, does hereby approve Tentative Tract No'. 335531 2. The -physical dev±blopment of the.herein described property shall conform to said Plan and .the following conditions which, except as otherwise expressly indicated, shall be: fully performed: and completed or shall be secured by bank or cash' deposit satis- factory to the Planning Director before the' use or..occupancy of the property is commenced and before a Certificate of Occupancy is issued, and the violation of any of which shall be grounds for.revocation.of said -Tentative Tract Map by the Planning'•Commis'sion or- City Council... a.
