Resolution - 5562RESOLUTION NO.' 5562 A RESOLUT,ION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING AND CERTIFYING AN ENVIRONMENTAL IMPACT REPORT FOR TENTATIVE TRACT NO. 33553 AND DEVELOPMENT PLAN NO..22 IN THE PCD-1 .ZONE (Hollenbeck Development Company). • The City'Council of the City of West Covina does hereby resolve as follows: WHEREAS,'there was filed with the City of West Covina verified applications for approval for the physical development of that certain property generally described as follows: Tentative Tract: a 63.3 acre parcel of land located at the northeast corner of Nogales Street and La Puente Road for an eleven (11) parcel subdivision. Development Plan: a 53.8 acre parcel of land located northeast of the intersection of Nogales Street and La Puente Road and proposed for the development of 976 apa.rtment.units; and WHEREAS,it was determined that said project could have a potential adverse impact on the environment and therefore an Environmental Impact Report should be prepared covering said project; and WHEREAS,,..a Draft Environmental Impact Report was pre- pared and completed.in June,.1977;' and WHEREAS, a copy of said Draft Environmental Impact Report was submitted to the following agencies for comment on • June 20, 1977: Air Pollution Control District Bein,.Frost Engineering City ofWalnut Hollenbeck Development Company HUD - Subdivisions L. A. County Flood Control District L. A. County Library, West Covina Branch L. A. County Regional Planning Department L. A. County Road Department L. A. County Sanitation District Rowland Unified School District Southern California Edison Company -Southern California Gas Company State Department of Planning and Research; and WHEREAS, the State Office of Planning and Research pub- lished in the California EIR.Monitor of June 27, 1977 reference to said Draft Environmental Impact Report; and WHEREAS, said agencies were given thirty (30) days to comment to .the Draft Environmental Impact Report; and • WHEREAS, a duly advertised public hearing was held before the Planning Commission on the Draft Environmental Impact Report on July 20.,. 1977; and • • WHEREAS, the Planning Commission of the. City of West Covina after_evaluating"the 'Draft Environmental Impact Report, testimony pertaining to said document and'Planning.Department com- ments relating to said testimony approved and certified the Environmental Impact Report for Tentative Map No.. 33553 and Development Plan No. 22 (PCD-1); and WHEREAS,„an appeal was filed on August 8, 1977, with the City Clerk requesting a City Council hearing concerning the de- cisions of the Planning Commission pertaining to Tentative Tract. No..33553 and Development Plan No. 22 (PCD-1); and WHEREAS, a duly advertised public hearing was held before the City Council on September. 12, 1977, to accept testimony pertaining to the Environmental.Impact Report certified by the Planning Commission; and WHEREAS,.pursuant to review of the Environmental Impact Report the following facts were revealed: Development Plan Environmental Impact 1. Soils .and Grading 2. Schools 3. Drainage Mitigating Measure Grading as per the approved devel- opment plan will be made to contour to existing topography. See page 14 of Environmental Impact Report for further details. on. Based/student generation• figures supplied by. Rowland School District, fewer students would be generated by proposed development as opposed to single family students generated by an R-1 development. Install solid core doors. -2- • • • Fire Recreation and Park Traffic - b. Install deadbolts with minimum one inch throw (with double cylinder)when within 36 inches of a window. C. Eye viewers in all exterior doors. d. Install locking devices on all sliding glass doors that will .prevent them from being lifted. e. Addressing and building identi- fication to Police Commander prior to building permits. Condition 27.a. - i, of Planning Commission Resolution. a. Amount of park land dedicated as part of Woodside Master Plan which included this parcel was for a greater density than deve- loped throughout planning area in general and this site in particular. b. Private recreation facilities required by condition 1 conform to Study Plan "A" which shows facilities and condition 9 requiring Precise Plan for all recreation facilities. These conditions are in Planning Commission Resolution 7-77-2764. Nogales and La - - signals being installed by County Puente Road at Nogales and La Puente, and Nogales and Northam. Access to Nogales - Stop signs would be installed at this time now, and developer would provide conduit and pole boxes. Access to La Puente - Stop signs would be installed at Road time of streets completion. Traffic signals not warranted. 6. Noise Some units within 65 dBA noise band., Grading short term See EIR on traffic capabilities vs. generation. By Building Code, noise level in unit cannot exceed'45 dBA (See page 18, EIR for methods). By meeting.OSHA Standards for muffling equipment. West Covina Code limits grading from 7 AM to 6 PM. -3- 7. That the Environmental Impact Report be supplemented • to include the minutes of.City Council meeting of September 12, 1977, by incorporation ofa copy of said minutes.in the final Environmental Impact Report. 2. That ,the City Council approve the final Environmental. Impact Report and -certify that said Environmental Impact Report has been completed'.in accordance with the Calif- ornia�'Environmental Quality Act. of 1970 as amended, the California State Environmental Impact Report Guidelines, and the City of.West Covina Environmental.Impact Report Guidelines. And further•that the City.Council has con sider'ed all.public input and has. reviewed and considered the information contained in,the Environmental Impact Report consisting of: A._ Draft Environmental Impact Report B. A'ddendums.to the Environmental Impact Report II'. Capacity traffic calculations and ADT service`.: I labels. iil. Comments and replies from responding public q agencies. iii. A supplemental Environmental Impact Report shall be pre- pared for any commercial development.proposed for Lot 11 of Tentative Tract Map No. 33553.
