Resolution - 5507w RESOLUTION NO. 5507 A RESOLUTION OF THE CITY COUNCIL .OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 1277 TO FIX THE COMPENSATION AND BENEFITS PAYABLE TO, AND AMENDING THE POLICIES APPLICABLE TO, EMPLOYEES WITHIN THE CITY OF WEST COVINA SERVICE. The City Council of the City of West Covina does resolve as follows: SECTION 1. Resolution No. 1277, the Salary Resolutibn�,`of the City of West Covina, is hereby amended by amending the following sections to read: a-)1 Section VI is amended to read as set out in Appendix "A" of this resolution. b) Section VII is amended as follows: 1) The Police Department authorized positions for the class of Police Agent are hereby assigned to Pay Range 29a. 2) Footnote #7 is amended to read: "7. A one-step differential for assignment as Detective for up to leleven Police Officers and one Sergeant. The differential for the Sergeant shall be eliminated when the incumbent leaves that position. In addition to the number of authorized full-time positions of Police Officer, additional full-time positions, not to -exceed four (4) , are authorized. Appointments to the addi- tional positions provided for in this footnote may only be made with the prior approval of the City Manager. " 3) Footnote #9 is amended to read: "9. A 5% differential is awarded when assigned 'Senior Com- munications' responsibilities in the absence of an available Communications Supervisor. " 4) Footnote #12 is amended to read: "12. Firefighters assigned to paramedic duty by the Fire Department receive a two -range differential (approximately 10. 2% for all work performed);:." 5) That portion of Section VII relating to pay of Limited Service classifications is amended to read as set forth in Appendix 'B" of this resolution. c) Section IX, paragraph (g) is amended to read as follows: • "(g) The Fire Chief shall, where possible, make replacement assignments from within the same rank as the absent employee provided that the replacement is fully qualified to perform all the duties required. If any position of Fire Engineer, Fire Captain, or Fire Battalion Chief is filled on a temporary basis by an,employee whose existing classification ,is a lower rank, he shall be paid a salary which is 5% above his then existing salary commencing with the first shift worked in the temporary assignment, provided that the employee is fully qualified to perform all the duties of that rank. Temporary • assignments to acting positions shall be made from the eligibility lists of qualified employees developed by the Personnel Office when such lists exist. In the absence of a current list, appoint- ments shall be determined by the Fire Department management staff. Trade of shifts shall not be allowed where such trading may result in overtime compensation for either of the employees involved, un- less such trading is expressly authorized by the Department Head. " d) Section X is amended as follows: 1) Paragraph (i) , subparagraph (4) is amended to read: "(4) Approved overtime for Fire Department employees entitled to it shall include only hours worked when employees are re- �quested or required to return to work by their department from off duty, provided however, that such employees shall receive a minimum of three hours pay for hours worked of three hours or less. Approved overtime for Fire Department employees entitled to dt also shall include time worked in .excess of 15 minutes as an extension of a regular scheduled shift, to be compensated on • the basis of 15 minute increments." 2) A new paragraph (j) is added to read: When conditions necessitate, employees in the Communica- tions Department and professional employees- in the Fire and Police Departments shall be required �on.a mandatory basis to hold over past the end of their normal shifts and/or to be called back to work during their off -duty time. Such action shall be taken.during emergency _situations as determined by the Depart- ment Head, including when staffing drops below department set minimum levels. e) Section XI is amended as follows: 1) Paragraph (a) is amended to read: "(a) Holidays for all officers and employees of the City of West Covina shall be: the 1st day of January, the 3rd Monday -in February, the lastMondayin May, the 4th.day of July, the 1st Monday in September, the llth day of November, the 25th day of December, and every day appointed by the President of the United States or the Governor of this state for a public fast, • Thanksgiving, or holiday, provided that on any day appointed by the President or by the Governor as a special or limited holi- day, City offices shall be open -and shall function in their nor- mal and usual manner, and all other public functions shall be performed as on days which .are not holidays. " - 2 - 2) Paragraph (b) is amended to read: "(b) Good Friday from 12:00 noon to 5:00 p.m., the Friday after the Thursday in November appointed as Thanksgiving Day, and three (3) floating personal leave days per calendar year, to be taken at times specified in administrative guide- lines, shall be permanent holidays for all officers and em- ployee's of the `_City-`o est CoVina except for_ profe"ssonal —_, • members of the Police and Fire Departments. The 12th day of February, the 9th day of September and the 2nd Monday in October also shall be holidays for employees in position classifications in the Police and Fire representation units." f) Section XIII is amended as follows: 1) Paragraph (a) is amended to read: "(a) Following completion of thirty calendar days of continuous full-time service, each city officer and employee paid upon•.a monthly bas�ils shall be allowed one (1) working day of credit for sick leave pay. Thereafter for each -calendar month of service, in which the employee has worked or has been paid vacation or sick leave for more than two-thirds (2/3) of the actual number of working days *of such month, he shall be allowed one day of credit for sick leave with pay. Unused sick leave may be accu- mulated without limit. Such sick leave with pay can only be granted upon the recommendation of the appointing. power of the employee, in case of a bona -fide illness of the employee or in the event of the serious illness or death of a member of the employee's immediate family. " • 2) Paragraph (h) is amended to read: "(h) For general (miscellaneous) employees, upon termination of continuous service other than by discharge, they shall be paid for 50 percent of all sick .leave accrued to the time of such termination which is in excess of 40 days, but does not exceed a maximum accrual of 100 days. No employee shall be entitled to be�paid for more than 60 days of accumulated sick leave. For employees in -position classifications represented by the Police Association, upon death, retirement, .or voluntary termin`ation, they shall be paid 1/3 of their accumulated and unused sick leave up to :a maximum of 50 days, provided however, that no ,eligibility for payoff of unused sick leave exists for employees terminating prior to three years of full time employment with the City. SECTION 2. Section lh'�of Resolution No. 5142, adopted November 10, 1975, is amended to read: "SECTION 1. The City Attorney shall receive as compensation a retainer of $1600 per month, beginning July 1, 1977. " •SECTION 3. Section,2 of Resolution No. 5265, adopted June 28, 1976, is amended to read: "SECTION 2. The salary of the City Manager shall be $39, 600 per annum, beginning July 1, 1977, payable in equal installments on regular City -pay- days. The City will pay to the Public Employees' Retirement System (PERS) an .amount equivalent to 7% of the salary of the City Manager on behalf of the employee's share of the retirement contribution, including survivor benefits. " 3- SECTION 4. Resolution No. 5446 is hereby amended by amending Section 3 thereof to read as set forth in Appendix C of this resolution. SECTION 5. Resolution No. 5501, approved July 11, 1977, is hereby re- pealed in its entirety and superceded by this resolution over any period during which it was in effect. • SECTION 6. Except where noted otherwise, this resolution shall be effective as of the first day of July, 1977. ATTEST: SECTION 7. The City Clerk shall certify to the adoption of this resolution.
