A RESOLUTION OF THE CITY COUNCIL OF THE
CITY.OF WEST COVINA AMENDING RESOLUTION
NO. 5489 DESIGNATING THE ENFORCEMENT
AGENCIES FOR SOLID WASTE MANAGEMENT IN
THE CITY -OF WEST COVINA
WHEREAS, the City of West Covina is required by Section
66796 of the Government Code to.designate an enforcement agency
to carry out the provisionsof the,Z'Berg=Kapiloff Solid Waste
Control Act of 1976; and
WHEREAS,.the County^and each City within the County of
Los Angeles has designated -or will designate its,.own enforcement
agents; and
WHEREAS, the State Health Department, -State of California,
Hazardous Waste-Division,.possesses the required.capabilities of
.solid waste management as it pertains to the landfill within the
City of West Covina;' and
WHEREAS, the County'of Los Angeles, Department of Health
Services, possesses the.required capabilities to enforce the
.health related standards for Gr6up.2 wastes as they pertain to
the landfill within the City of West Covina; and
WHEREAS, the City Engineer of the City of West Covina
possesses the required capabilities to enforce the Solid Waste
Management Standards and the regulations of;Unclassified Use
• Permit. No. 71 pertaining to'the.operation.of the BKK Sanitary
Landfill.;
NOW, THEREFORE., : BE IT RESOLVED ASr1�iFOLLOWS :
SECTION 1. The City Council of the City of West.Covina
designates the California,:State Department of Health as the
enforcement agency.for Hazardous.Wastes; the County of Los Angeles,
Department of. Health._ Services, �as the. enforcement agency for the
Group 2 wastes Health,.Related Standards, and'the City Engineer
as the enforcement -agent for.the Solid.Waste Management Standards
pertaining to,the operation of the sanitary landfill located
within the City of°West Covina.
SECTION 2. The City Clerk shall certify to the adoption
of this resolution.
