Resolution - 5493• RESOLUTION NO. 5493 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA APPROVING A PRECISE PLAN OF DESIGN (Precise Plan No. 693 - Donald H. Britt). The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Donald H. Britt requesting, the approval of a Precise Plan of Design for the construction of a 44-unit apartment complex on a 2.25-acre portion of Lots 137 and 138 of E. J. Baldwin's Fourth Subdivision, Book 8, Pages 186 and 187 of Maps on file in the office of the County Recorder of Los Angeles County, all as more parti- cularly described in Precise Plan of Design Application No.. 693; that hearings thereon were duly conducted by the Planning Commission and the Planning Commission approved the application subject to conditions; that the matter was called up by.the City Council for hearing in connection with Zone Change Application No. 517 and the City Council held a hearing thereon and proper and legal notice of the hearing was duly given. SECTION 2. Precise Plan of Design No. 693 is hereby approved pursuant to the provisions of the West Covina Municipal Code, provided that the physical development of the property included therein shall conform to said plan and each and all of the conditions of precise plan approval contained in Planning Commission Resolution No. 6-77-2749, which resolution is by this reference incorporated herein. Except as otherwise expressly indicated in Planning Commission Resolution No. 6-77-2749, and in this resolution, each and every one of the conditions contained in that resolution and in this reso- lution shall be fully performed and completed or shall be secured by a bank or cash deposit satisfactory to the Planning Director before the use or occupancy of the property is commenced and before a Certificate of Occupancy is issued. The violation of any of said conditions shall be grounds for the revocation of Precise Plan of Design No. 693 by the Planning Commission or the City Council. SECTION 3. An Environmental Impact Report for the project has been certified in connection with the application for a change of'zone upon the same parcel and has been found to have been prepared in accordance with the requirements of the California Environmental Quality Act of 1970 and the State Guidelines adopted pursuant thereto. SECTION 4. This resolution shall be effective only if and at the same time as the ordinance changing the existing zone on the subject property from Residential Agricultural (R-A) zone, Area District II, to' Medium Density Multiple Family (MF-20) zone is effective. SECTION 5. The City Clerk shall certify to the adoption of this resolution . Adopted and approved this llth day of July, 1977.
