RESOLUTION NO. 5467
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA APPROVING THE FINAL
SUBDIVISION MAP OF TRACT NO. 32981 ACCEPT-
ING AN AGREEMENT BY THE SUBDIVIDER AND
SURETY BONDS TO SECURE THE SAME.
WHEREAS, there has been submitted to this meeting by
the owner and subdivider thereof, a final subdivision map of
Tract No. 32981 which has been approved by the Planning
Commission and by the City Engineer; and
WHEREAS, there has been submitted to this meeting a
proposed agreement by the subdivider for the construction of
certain improvements within or for said subdivision; and
WHEREAS, said proposed agreement is accompanied by
surety bonds for the faithful performance of the terms and
conditions of said agreement;
NOW, THEREFORE, the City Council of the City of West
Covina does resolve as follows:
SECTION 1. That the final subdivision map of Tract
No. 32981 submitted to this meeting be and the same is hereby
approved.
SECTION 2. That the dedication therein offered by
and the same is hereby accepted for public use, excepting the
offer to grant Lots 65, 66 and 67, subject to any restriction
to be filed and recorded therewith; and that the proper officers
of the City of West Covina be and they are hereby authorized
and instructed to approve said final map on behalf of the City.
SECTION 3. That the proposed agreement by the sub-
divider in the form submitted to this meeting be accepted.
SECTION 4. That the Surety Bonds Numbers 400 DR
4400/134, 400 DR 4400/135, 400 DR 4400/137 and 400 DR 4400/140
presented as security for the faithful performance the terms
and conditions of said agreement with UMARK INC. as principal,
and St. Paul Fire and Marine Insurance Company as surety, in
the total sum of One Million One Hundred Twenty Nine Thousand
Six Hundred Ten and No/100 Dollars ($1,129,610.00) be and the
same hereby are accepted.
SECTION 5. That the City Clerk shall certify to the
adoption of this resolution.
