RESOLUTION NO. 5452
A RESOLUTION OF THE CITY COUNCIL OF THE
• CITY OF WEST COVINA, RELATING TO THE TIME
AND METHOD OF OPENING BIDS FOR PUBLIC WORKS
PROJECTS AND SPECIFYING THE PROCEDURE TO
BE FOLLOWED IN CONNECTION WITH BID AND.BOND
SECURITY AND REPEALING RESOLUTION NO. 935.

The. City Council of the City of'West Covina does
resolve as follows:
. SECTION 1. Whenever sealed proposals for bids are
requested by the City Council for any public works project, such
proposals or bids shall be delivered to the City Clerk who shall
publicly open, examine and declare the same at the office of the
City Clerk in the City Hall, West Covina, California, upon the day
and at the time specified in the Notice Inviting Bids, which shall
be only.during normal business hours. After the opening of such
bids, the City Clerk shall deliver the bid documents to the City
Engineer for analysis and the preparation of a report and recom-
mendation to the City Council.
SECTION 2. Whenever bids are invited and received
by the City Council for any public works project, the security
accompanying any such bid and consisting of cash, cashier's check,
certified check, or surety bond made payable to the City, shall be
retained for a period of 30 days. At the conclusion of that time,
the bid security will be returned to any bidder whose proposal is
not to be considered in making an award or whose proposal is rejected
by the City Council. The bid security of the three lowest bidders
shall be retained by the City until the contract relating to the
public works project has been duly executed, after which it will be
returned to the depositor.
SECTION 3. Whenever a bond is required for public
improvement purposes, the bond shall be in the form of a surety bond.
Bonds shall be duly executed by a responsible corporate surety
authorized to issue such bonds in the State of California and secured
through an authorized agent with an office in California. The con-
tractor shall pay all bond premiums, costs and incidentals.
SECTION 4. Resolution No. 935, adopted on the 7th day
of May, 1956, and as amended by Resolutions numbered 1628 and 3072,
is hereby repealed.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
