Resolution - 5433RESOLUTION NO. 5433, A RESOLUTION OF THE „CITY COUNCIL OF'%TwE • CITY OF WEST COVINA APPROVING PRECISE PLAN OF DESIGN,,NO. 691 (Brattain Con- A tractors, Incorporated): -The City Council of the' City; of .Wes_t ,,Covina does resolveas follows: SECTION l.. The City Council:does°.:hereby-find and determine that there was filed with the'Planning,Commission an application of Brattain Contractors, Incorporated; requesting the approval of a Precise Plan of•Design for'the construction of a 76-unit apartment complex on a 5.04 acre -parcel located on the north side of Valley Boulevard approximately 425' west of Nogales Street, all as more particularly described in Precise Plan of Design application No. 691; that,.: hearings thereon were duly con- ducted by the Planning Commission and the Planning Commission approved the application subject to.conditions; that.the matter came before the City Council in connection with Zone Change Appli- cation No. 511 and the City Council held a hearing thereon and proper and legal notice of the hearing was duly given. SECTION 2. Precise Plan of Design No. 691 is hereby approved pursuant to the provisions of the West Covina Municipal Code provided that the physical development of the property included therein shall conform to said plan and each and -all of • the conditions of Precise Plan approval contained in Planning Commission Resolution No. 3-.77-2721, which Resolution is by this reference incorporated herein. Except as otherwise expressly indicated in Planning Commission Resolution No.'3-77-2721.and.in this resolution, each and every one of the conditions contained in th°at<said 'resolution and in this resolution shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the. Planning Director before the use or occupancy of the property is commenced and before a Certificate.of Occupancy is issued. The violation of any of said conditions.shall be grounds for the'revo- cation of Precise Plan No. 691 by the Planning Commission or the City Council. SECTION 3. Pursuant to the provisions of Section 9205.5 of the West Covina Municipal.Code,'the maximum net density for the project is waived and Brattain Contractors, Incorporated,.is hereby authorized to increase the net density of the project to. 15.08 units per net acre. This waiver of the density requirement is acceptable on the basis of the amount of property required for street dedi cation and the location of the property•with reference to existing developments. SECTION 4. An Environmental Impact Report for the project has been certified in connection with the application for • a change of zone upon the same parcel and has been found to have been.prepared in accordance with.the requirements of the California Environmental Quality Act of '-1970 •and..the . S'tatea; Guidelines adopted pursuant thereto. • 0 SECTION 5. This resolution shall be effective only if, and at the same time as, the ordinance changing the existing zoning on the subject property from S-C (Service Commercial Zone) to MF-15 (low density multiple family zone) is effective. SECTION 6. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this llth day of April, 1977.
