Resolution - 5413RESOLUTION NO. 5413 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA REPEALING RESOLUTION NO. 4658 AND VACATING AND ABANDONING A PORTION OF A STREET WHICH HAS BEEN SUPERSEDED BY RELOCATION (Monte Verde Drive) WHEREAS, by cooperative agreement dated July 1, 1968, between the City of West Covina and the State of California, the City and the State agreed to cooperate in the widening from six to eight lanes of that portion of the San Bernardino Freeway which is within the City, and WHEREAS, the State has awarded the contract for the freeway widening including the closure and relocation of a portion of Monte Verde Drive between Holt Avenue and Garvey Avenue, and WHEREAS, when the widening of the San Bernardino Freeway is completed, that -portion of the existing Monte Verde Drive which is hereinafter described will have been superseded by relocation; NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION.1. Pursuant to Sections 1930 to 1934, inclusive, of the Streets and Highways Code, the City Council of the City of West Covina hereby finds and determines that the following described portion of Monte Verde Drive has been.superseded by relocation: A portion of Monte Verde Drive in the City of West Covina, County of Los Angeles, State of California, described as follows: • Commencing at the intersection of the center line of said Monte Verde Drive with the center line of Holt Avenue, as said intersection is shown on Map No. 11786, Sheet 4, on file in the office of the County Surveyor of'said county; thence,_,along the center line of said Monte Verde Drive, S 25945' 13" E, 271.98 feet; thence, at right angles to said center line, N 640 14' 47" E, 25.00 feet to a point in the Southwesterly line of Lot 16, Tract No. 10330 as shown on map recorded in.Book 161, pages 22 through 31, of Maps, Official Records of said county, said point being the most Southerly corner of the land described in the deed recorded in Book 39472, page 62, Official Records of said county and said point being the TRUE POINT OF BEGINNING of this description; thence, S 250 45' 13" E, 26.11 feet to a curve, concave Northerly and having a radius of 197.00 feet; thence, from a tangent which bears S 800 33' 28" W, through an angle of 160 00' 35", a distance of 55.05 feet, to a point on the Northeasterly line of Lot 26 of said Tract No. 10330; thence along said Northeasterly line of Lot 26, parallel with and distant 50.00 feet Southwesterly from said Southwesterly line of Lot 16, N 250 45' 13" W, 167.55 feet to a point,of tangency with a curve, concave South- westerly and having a radius of 99.68 feet; thence, North- westerly along said curve, through an angle of 460 02' 07", a.distance of 80.09 feet, to a point of intersection with a curve, concave Northerly and having a radius of 3048.00 feet; thence from a tangent which bears N 730 10' 21" E, Easterly along said curve having a radius of 3048.00 feet, • • through an angle of 10 25' 14", a distance of 75.5-7 feet to'a point of intersection with a reserve curve, concave Southerly and having a radius of 200.00 feet; thence, from a common tangent which bears N 710, 45' 07" E, Easterly along said curve having a radius of 200.00 feet; thence, from a common tangent which bears N 710 45' 07" E, Easterly along said curve having a radius of 200.00 feet, through an angle of 120 17' 20", a distance of 42.90 feet to a point of intersection with a curve, concave.Southeasterly and having a radius of 66.75 feet; thence, from a tangent which bears S 360 43' 54" W, South- westerly along said curve having a radius of 66.75 feet to a tangent -lying, , n. ;the •a,for.esa'i.d-Southwesterly line of Lot 16, Tract No. 10330; thence, along last said tangent and Southwesterly line, S 250 45' 13" E, 155.67 feet to the TRUE POINT OF BEGINNING OF this description; and RESERVING AND EXCEPTING from said vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and tele- phone lines, and for the transportation or distribution of electric energy and water lines, including access to protect the property from :all` hazards in, upon, and over the street or part thereof proposed to be vacated,and reserving and excepting therefrom a 12.00 foot easement, the center- line.being the centerline of said Monte Verde Drive, for bridle trail purposes. SECTION 2. That -portion of existing Monte Verde Drive de- scribed in Section 1 hereof is hereby summarily vacated and abandoned. SECTION 3. Resolution No. 4658 dated November 27, 1972 is hereby repealed. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified copy -thereof to be trans- mitted to the State Division of Highways, 107 South Broadway, Los Angeles, California. The City Clerk shall also cause a certified copy of this resolution to be recorded in the office of the County Recorder upon the completion of the widening of the San Bernardino Freeway, and the acceptance by the City of control over relocated and reconstructed Monte Verde Drive.
