A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA APPROVING PRECISE
PLAN NO. 690 (Virgil Butler, Ted Block
Datsun and Bozzani, Inc.)
THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council does hereby find and determine
that there was filed with the Planning Commission the application of
Virgil Butler, Ted Block Datsun and Bozzani, Inc., requesting the
approval of a Precise Plan of Design for the construction of a new
and used automobile sales facility on a 1.22 acre portion of the
site and a full scale automobile agency, including sales, service
and repairs, on the remaining 2.44 acres of the site which is
located on Garvey Avenue east of Azusa Avenue and south of the San
Bernardino Freeway, all as more particularly described in Precise
Plan of Design No. 690; that hearings thereon were duly conducted
by the Planning Commission and the Planning Commission approved
the application subject to conditions; that the matter came before
the City Council in connection with Zone Change Application No. 510
and the City Council held a hearing thereon and proper and legal
notice of the hearing was duly given.
SECTION 2. Precise -Plan of Design No. 690 is hereby approved
pursuant to the provisions of the West Covina Municipal Code,
provided that the physical development of the property included
therein shall conform to said plan and each and all of the condi-
tions of Precise Plan approval contained in Planning Commission
Resolution No. 1-77-2707 which Resolution is, by this reference,
incorporated herein, and shall conform to each and all of the follow-
ing additional conditions:
1. No exterior voice sound amplification system
shall be installed for use in connection
with any automobile sales, service or repair.
facilities constructed or.maintained on the
property described in Precise Plan of Design
No. 690.
2. 'A sign to be approved by the Planning Director
shall be erected and continuously maintained
in any automobile repair facility constructed
or maintained on the site which will expressly
prohibit the road testing of any vehicle on
any residential street.
Except as otherwise expressly indicated in Planning Commis-
sion Resolution No. 1-77-2707 and in this Resolution, each and every
one of the conditions contained in said resolution and in this
resolution shall be fully performed and completed or shall be
secured by bank or cash deposit satisfactory to the Planning Director
before the use or occupancy of the property is commenced and before
a Certificate of Occupancy is issued. The violation of any of said
conditions shall be grounds for the revocation of Precise Plan
No. 690 by the Planning Commission or the City Council.
SECTION 3. The Negative Declaration of Environmental Impact,
as prepared by the Planning Department and approved by the Planning
Commission after notice and public hearing, is hereby adopted and
is found to have been prepared in accordance with the requirements
of the California Environmental Quality Act of 1970 and the State
Guidelines adopted pursuant thereto.
• SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
