A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, AMENDING RESOLUTION
NO. 1277 TO FIX THE COMPENSATION AND BENEFITS
PAYABLE TO, AND TO AMEND THE POLICIES APPLICABLE
TO, POLICE CADETS WITHIN THE WEST COVINA CITY
SERVICE, AND AMENDING RESOLUTION NO. 1276.
WHEREAS, pursuant to individual employee discussions and in
order to al gn_benefits of Police Cadets with other miscellaneous employees;
NOW, THEREFORE, the City Council of the City of West Covina does
resolve as follows:
SECTION 1. That portion of Section VI of .Resolution No. 1277
relating to salary rates for Police Cadets, Range 16a, is amended to read
as follows:

*Effective December 1, 1976, the City will pay to the Public Employees
Retirement System (PERS) the amount defined by PERS as deferred compen-
sation equivalent to 7% of the salaries for Police Cadets on behalf of
the employees' share of the retirement contribution. The amounts in
parentheses should be used when comparing salaries, as they include the
deferred compensation paid to employees by City payment of the employees'
share of the PERS contribution."
SECTION 2. That portion of Section VI of Resolution No. 1277
• relating to salary rates for Police Cadets is amended by addition of a
footnote as follows:
"**Across the board increase, effective February 1, 1977, adds
$40 to each step in the range and is not reflected in the above base
amounts or the amounts in parentheses."
SECTION 3. Paragraphs (a).and (b) of Section XI of Resolution
No. 1277 is amended to read as follows:
"Section XI. Holidays.
(A) Holidays for all officers and employees of the City of
West Covina shall be: the lst day of January, the 3rd Monday in Feb-
ruary, the last Monday in May, the 4th day of July, the 1st Monday in
September, the 2nd Monday in October, the llth day of November, the 25th
day of December, and every day appointed by the President of the United
States or the Governor of this state for a public fast, thanksgiving, or
holiday, provided that on any day appointed by the President or by the
Governor as a special or limited holiday, City offices shall be open and
shall function in their normal and usual manner, and all other public
functions shall be performed as on days which are not holidays.
(B) Good Friday from 12:00 noon to 5:00 p.m., the Friday after
the Thursday in November appointed as Thanksgiving Day, and two (2) float-
ing holidays per calendar year, to be taken at times specified in adminis-
trative guidelines, shall be permanent holidays for all officers and
employees of the City of the City of West Covina except for professional
members of the Police and Fire Departments. The 12th day of February and
the 9th day of September shall also be holidays for professional members
of the Police and Fire Departments."
SECTION 4. Section XIII.1 of Resolution No. 1277 is amended
to read as follows:
"Section XIII.l. Disability in Course of Duties.
:(A)'., Whenever any employees of the City are disabled, whether
temporarily or permanently, by injury or illness arising out of and in
the course of their duties, they shall be entitled, regardless of their
period of service with the City, to leave of absence while so disabled,
7 without loss of salary (temporary disability compensation, if any, being
considered as and credited to salary for this purpose) for the period
of such disability, but not exceeding one year, or until such earlier
date as they are retired on permanent disability pension; and the leave
of absence hereby granted shall be in addition to, and shall not be
charged to or deducted from, accumulated sick leave except as provided
herein. Such leave, however, shall not be paid for. more than seven days
unless and until such employees are awarded or receive disability bene-
fits under the Workers' Compensation and Insurance Law of the State of
California based upon such disability. When and while applicable, this
section shall supersede the provisions of paragraph (e) of Section XIII.
(,B) Relative to miscellaneous employees: (1) promotion or
step increases which would have come due during a disability leave
shall take effect upon the day the employee returns to regular duties
in accordance with existing rules; (2) holidays occurring during a
disability leave shall not be counted as disability leave days, but
shall be considered as holidays for which time off has been utilized;
and (3) vacation and sick leave benefits shall not be accumulated during
a period of disability leave of a continuous period of more than 30
calendar days or of a leave of a discontinuous period totaling more than
90 calendar days for the same injury or illness.
'(C) The first three (3) days of absence of a miscellaneous
employee due to disability shall be charged to the employee's usable
•accumulation of sick leave or other time off benefits; provided however,
that the Safety Committee or its subcommittee, upon request of the
employee, shall review the circumstances of the injury. If the Safety
Committee rules that the employee.had no possible opportunity to pre-
vent or reduce the injury through any alternative action, disability
time off charged to the employee's time off benefits may be restored.
Such restorations shall be limited to cases where no danger could have
been anticipated or precautions and actions taken by the employee to
prevent or reduce the injury. Appeal of Safety Committee determinations
provided for in this section shall be made to the City Manager, whose
decision shall be final.
(D) No professional members of the Police and Fire Departments,
while on or entitled to disability leave -of absence, shall suffer the loss
of any vacation, sick leave, or increase in compensation which would have
accrued, or to which he would have been entitled if he were actually per-
forming his duties."
SECTION 5. 'Rule III.5 of the Personnel Rules (Resolution
No. 1276) is amended to read as follows:
"III.5. Acting Temporary Appointments to a Higher Class.
An acting appointment may be made to a higher class or position
occupied by a person on temporary leave or disability. Such acting
appointment shall not exceed 12 months. Acting appointments shall be
•made from existing eligibility lists. Should no eligibility list exist,
acting appointments shall be made in accordance with Section III.4 of
the Personnel Rules. Miscellaneous employees serving in an acting
status shall receive a full step increase in compensation payable from
the 31st calendar day of such appointment until the completion of the
appointment, provided such acting appointments are made in writing by
the appointing authority with a copy to the Personnel Office. Profes-
sional employees of the Police Department shall be compensated for acting

appointments in accordance with Section 8 (e) of Personnel Resolution
No. 1277, and such compensation shall be payable from the date of
appointment to the date of termination, provided such an appointment
exceeds 90 calendar days. The acting appointee shall receive no
additional compensation while serving in an acting status except as
provided for in this section. Upon the return of the incumbent from
leave or disability, the acting appointment shall be immediately
terminated, and the appointee shall resume regular duties, compensation,
and privileges as if he or she had continued his or her duties in the
0,ermanent or regular classification. Professional employees of the Fire
Department serving in an acting status shall be compensated in accordance
with provisions of Salary Resolution No. 1277.
SECTION 6.. Police Cadets shall be entitled to benefits avail-
able to all miscellaneous employees (unless specifically excepted) in
keeping with their status as miscellaneous employees. Such entitlement
to benefits shall include City provision of the long-term disability
insurance policy currently being provided other miscellaneous employees.
? In order that current long-term disability benefits
are reflected in the Personnel Resolution, a- "new. Sect-io_n--XIII -3 is hereby
added to Resolution No. 1277 to read as follows:'
"Section XIII. 3 . Lif:Lonct Term Disab�il.ity -Insurance
The City :may. provide to current full-time miscellaneous
employees, group long-term disability insurance cover age,Ea-nd_growp, life
,insurance` -coverage to be paid wholly by the City."
SECTION 7 Section 1, Section 3, Section 4, and Section 5
shall be effective as of the .first pay period in December, 1976.
Section 2 and Section 6 shall be effective as of the first pay period
in February, 1977.
SECTION 8. The City Clerk shall certify to the adoption of
this resolution.
