RESOLUTION NO. 5360
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA VACATING AND ABAN-
DONING A PORTION OF A STREET WHICH HAS
BEEN SUPERSEDED BY RELOCATION (KIMBERLY
DRIVE)
WHEREAS, the portion adjacent to and easterly of said
Kimberly Drive is to be resubdivided, using the vacated portions
of Kimberly Drive, and
WHEREAS, Kimberly Drive has never been physically
built;
NOW, THEREFORE, the City Council of the City of West
Covina does resolve as follows:
SECTION 1. Pursuant to Sections 1930 to 1934, in-
clusive, of the Streets and Highways Code, the City Council of
the City of West Covina hereby finds and determines that the follow-
ing described portion of Kimberly Drive has been superseded by
relocation:
That portion of Kimberly Drive, 49.00 feet wide, in the City of
West Covina, County of Los Angeles, State of California, as shown
on Tract Map No. 28406, per map recorded in Book 866, Pages 21, 22
and 23 and 100 of Maps on file in the office of the County Recorder
of said County, bounded as follows:
Bounded southerly by the northerly line of Gemini
Street; bounded northerly by the following des -
scribed line: Beginning at a point on the westerly
line of Lot 153 of said Tract 28406, distant North
60 12' 14" West, 241.58 feet from the most westerly
corner of said Lot 153, said point being the begin-
ning of a tangent curve concave northeasterly and
having a radius of 40.00 feet; thence easterly
along said curve, through a central angle of
1150 59' 55" an arc length of 80.98 feet.
EXCEPTING AND RESERVING THEREFROM said vacation
the permanent easement and right at any time or
from time to time, to construct, maintain, operate,
replace, remove and renew sanitary sewers and appurt-
enant structures thereof; including access and the
right to keep the property free from inflammable
materials and wood growth, and otherwise protect
the same from all hazards in, upon and over the
street or part thereof proposed to be vacated, des-
cribed as follows:
A strip of land 1000' wide, the centerline being a
line parallel with and 25.00 feet easterly, measured
at right angles, from the westerly line of said Tract
28406, within said vacation..
SECTION 2. That portion of Kimberly Drive described in
isSection 1 hereof is hereby summarily vacated and abandoned.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution and shall cause a certified copy thereof to be
recorded in the office of the County Recorder of said County.
