Resolution - 5352RESOLUTION NO. 5352 A. RESOLUTION OF THE CITY COUNCIL OF THE CITY • OF WEST COVINA. GRANTING UNCLASSIFIED USE PERMIT NO, 212 (Fotomat Corporation). . The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Fotomat Corporation requesting the granting of an unclassified use permit to con- struct a building for the operation of a drive-thru photo service business in the, heavy commercial (C-3) Zone on property located on a portion of Lots 47 and 48, Forster and Rowland Tract, Map Book 20, Page 14 and 15 and as more particularly described in the application for Unclassified Use Permit No. 212; that hearings thereon were duly conducted by the Planning Com- mission and the Planning Commission approved the application subject to conditions; that the matter of certain conditions was appealed to the City Council and the City Council held a hearing thereon and proper and legal notice of the hearing was duly given. SECTION 2. It is hereby found by the City Council that: (a) The site is adequate in size and is so designed as to accommodate said use and the proposed use will be • compatible with the existing commercial business on this shopping center site and will be compatible with the immediately surrounding commercial businesses in the neighborhood. (b) The granting of the Unclassified Use Permit will not adversely affect the General Plan of the City and will not be materially detrimental to the public welfare. SECTION 3. Unclassified Use Permit No. 21,2 is hereby granted pursuant to the provisions of the West Covina Municipal Code provided that the physical development of the property included therein 'shall ocnform. to said permit and to each and all of the following conditions: 1. Conform to Study Plan "A", dated October 6, 1976. 2. Conform to Exhibit I, Elevations; dated October 6, 1976, except that the. materials- used shall be wood shake or tile roof and masonry ,walls, to be approved by the Planning Director prior to the issuance of a building permit. 3. A landscaping. plan, including size, type and quantity of • plant materials, as well as a fully automatic watering system, shall be submitted to the Planning Director for review and approval prior to the issuance of a building permit. 4. Signs are not a part of this approval, and'shall be sub- mitted to the Planning Director for review prior to issuance of a permit. 5. If the use provided for herein is discontinued for a period • of ninety (90)'days, all improvements constructed under this unclassified use permit shall be removed from the premises and the parking spaces shall be restored to their original condition. 6. Engineering Department Requirements: a. Applicant to comply with all conditions contained in Planning Commission Resolution No. 567. b. The required street dedication shall include that portion of Valley Boulevard (5 feet) contiguous to subject property. C. A final grading and drainage plan showing existing and proposed elevations and drainage structures shall be submitted for the approval of the Building and Engi- neering Department prior to issuance of a building permit. d. Adequate provision shall be made for acceptance and disposal of surface drainage entering the property from adjacent areas. • e. Parking lot and driveway improvements on private property shall comply with Planning Commission Resolution No. 2513 and be constructed to the City of West Covina Standards. f. A parking lot lighting plan showing electrolier, types, and locations, average illumination levels, points:.of. minimum illumination and photometric data as requested shall be submitted for the approval of the City Engineer and Planning Director. 7. Building Department Requirements: Proposed construction to comply with Fire Zone 2 requirements. SECTION 4.. The negative declaration of environmental impact, as prepared by the Planning. Department and approved by the Planning Com- mission, is hereby adopted and is found to have been prepared in accordance with the requirements of the California Environmental Quality Act of 1970 and the State Guidelines adopted pursuant thereto. SECTION 5. The City Clerk shall certify to the adoption of this • resolution.
