A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF WEST COVINA. APPROVING PRECISE PLAN NO. 680
(Joseph K. Eichenbaum - El Torito Restaurant)
The City Council of the City of West.Covina does resolve as
follows:
SECTION 1. The City Council does hereby find and determine
that there was filed with the Planning Commission the application of Joseph
K. Eichenbaum requesting the approval of a Precise Plan of Design for a
restaurant in the Regional Commercial (R-C) Zone on a 1. 762 acre portion
of Lot, 6, Block 2.5 of the Phillips Tract, in the City of West Covina, Book
9, Pages 3 and 4 of Miscellaneous Maps, all as more particularly described
in Precise Plan of Design No. 680, that hearings thereon were duly conducted
by the Planning Commission and the .Planning Commission approved the
application subject to conditions; that the matter was appealed to the City
Council and the City Council held a hearing thereon and proper and legal
notice of the hearing was duly given.
SECTION 2. Precise Plan of Design No. 680 is hereby approved
pursuant to the provisions of the West Covina Municipal Code provided that
the physical development of the property included therein shall conform to
• said plan and each and all of the conditions of precise plan approval cQn.-
tained in Planning Commission Resolution No. 10-76-2682 which resolution
is, by this reference, incorporated herein.
Except as otherwise expressly indicated in Planning Commission
Resolution No. 10-76-2682 and this resolution, each and every one of the
conditions contained in said resolution and in this resolution shall be fully
performed and completed or shall be secured by bank or cash deposit
satisfactory to the Planning Director before the use_ or occupancy of the
property is commenced and before a certificate of occupancy is issued.
The violation of any of said conditions shall be grounds for the revocation
of Precise Plan No. 680 by the Planning Commission or City Council.
SECTION 3. The negative declaration of environmental impact,
as prepared by the Planning Department and approved by the Planning Com-
mission, is hereby adopted and is found to have been prepared in accordance
with the requirements of the California Environmental Quality Act of 1970
and the State Guidelines adopted pursuant thereto.
SECTION 4. The City Clerk shall certify to the adoption of this
resolution.
