A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA DETERMINING CERTAIN PUBLIC IMPROVEMENTS TO BE
• OF BENEFIT TO THE EASTLAND REDEVELOPMENT PROJECT;
CONSENTING TO THE PAYMENT BY THE REDEVELOPMENT AGENCY
OF THE CITY OF WEST COVINA TO THE CITY OF THE VALUE OF
THE LAND FOR THE INSTALLATION AND CONSTRUCTION OF SUCH
PUBLIC IMPROVEMENTS; AND APPROVING AND AUTHORIZING THE
EXECUTION OF A COOPERATION AND REIMBURSEMENT AGREEMENT
THEREFOR BETWEEN THE CITY AND THE AGENCY.
WHEREAS, the City of West Covina is undertaking the reconstruc-
tion of the Holt Avenue bridge over the Walnut Creek Wash and the
realignment of Holt Avenue in conjunction therewith; and
WHEREAS, the Holt Avenue bridge and Holt Avenue adjoin the
Eastland Redevelopment Project and the reconstruction and realignment
project are necessary for the execution of the Project under the provisions
of the California Community Redevelopment Law (Health and Safety Code,
Section 33000 et seq.) and pursuant to the Redevelopment Plan for the
Project, which Redevelopment Plan was adopted on July 14, 1975 by
Ordinance No. 1269 of the City Council; and
WHEREAS, the City is to acquire certain real properties required
for the realigned right-of-way of Holt Avenue and has undertaken (or is
to undertake) the construction work necessary for the reconstruction of
the Holt Avenue bridge and the realignment of Holt Avenue; and
WHEREAS, the Redevelopment Agency of the City of West Covina
desires to reimburse and pay the City for the value of the land acquired
for the realignment of Holt Avenue, the. terms and provisions of such
reimbursement being contained in a "Cooperation and Reimbursement Agree-
ment" between the City and the Agency which is attached hereto and labeled
as Exhibit "A"; and
WHEREAS, Section 33445 of the California Health and Safety Code
requires the City to consent to such reimbursement payments and to
determine the issue of benefit to the Eastland Redevelopment Project
prior to such payments being made by the Agency to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WEST COVINA AS FOLLOWS:
SECTION 1.. It is hereby determined that the installation and con-
struction of the public improvements necessary for the reconstruction of the
Holt Avenue bridge and the acquisition of the land and the installation and
construction of the public improvements necessary for the realignment of
Holt Avenue are of benefit to the Eastland Redevelopment Project.
SECTION 2. The City Council hereby consents to and approves the
reimbursement and payment by the Redevelopment Agency of the City of West
Covina to the City for the value of the land acquired for the realignment
of Holt Avenue, as set forth in the attached "Cooperation and Reimburse-
ment Agreement".
• SECTION 3. The City Council hereby approves the attached
"Cooperation and Reimbursement Agreement", and hereby authorizes the
Mayor to execute, and the City Clerk to attest to, said agreement on
behalf of the City.
