A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST C OVINA APPROVING A. SITE
• MODIFICATION T.O PERMIT TWO EXISTING
SINGLE FAMILY DETACHED UNITS TO BE
LESS THAN TEN FEET APART (TRACT #31102)
The City Council of the City of West Covina does resolve .
as follows:
SECTION 1. The applicant, Kaufman and Broad applied
to the Planning Commission for a modification from the Woodside Village
Development Standard requiring a. minimum of ten feet between opposing
structures. The structures on Lots 21 and 22 on Tract #31102 were placed
at an angle to the side lot lines rather than parallel to them and the dis-
tance from structures on Lots 22 and 23 range from 8. 8 feet to 9. 6 feet.
After notice and hearing, the, Planning Commission denied the requested
site modification. The applicant appealed the denial of the site modifica-
tion to the City Council.
SECTION 2. The City Council, after notice and public
hearing, does find and determine that the public necessity and conven-
ience requires 'the approval of the requested site modification, subject
to certain conditions required to protect the purchasers of the affected
property.
SECTION 3. The site modification as petitioned by Kaufman
and Broad for PCD-1, Development Plan #9, Tract #31102; Lots 22 and.
23 is hereby approved subject to the following conditions:
1. Any windows in structures located on the lots
which are less than ten feet a part shall be of
thermal paned glass or equivalent and approved
by the Director of Building and Safety.
2. A sixfoot masonry wall shall be constructed
along the site property line from the rear lot
line to the front setback line.
3. Revised drainage plans for Lots 22 and 23 to
be submitted to the City Engineer for approval.
4. That there be recorded with the deeds to Lots
22 and 23 a warning to prospective buyers that
the setback requirements of the houses on the
lots may not meet Federal Housing Authority
financing requirements. A. certified copy of
• the recorded document shall be filed with the
Planning Director.

5. Any costs related to compli.anc'e to these con-
ditions shall not be passed on to the purchasers
of the homes located on the lots and written
verification from the original purchaser that
they are aware of these conditions shall be
filed with the Planning Director.
SECTION 4. The City Clerk shall certify as to the adoption
of this resolution.
