A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION
NO. 1277 TO FIX THE COMPENSATION AND BENEFITS
PAYABLE TO FIREFIGHTERS, FIRE ENGINEERS, FIRE
CAPTAINS, AND FIRE BATTALION CHIEFS; AND
AMENDING RESOLUTION NO. 1276.
The City Council of the City of West Covina does resolve
as follows:
SECTION 1. Those portions of Section VI of Resolution
No. 1277 relating to salary rates for professional fire employees
are amended to read as set forth in Exhibit A attached hereto, and
by this reference incorporated herein.
SECTION 2. Paragraph (g) of Section,IX, Resolution No. 1277,
is amended to read as follows:
(g) "The Fire Chief shall, where possible, make replacement
assignments from within the same rank as the absent
employee provided that the replacement is fully qualified
to perform all the duties required.
"If any'•position of Fire Engineer, Fire Captain, or Fire
Battalion Chief is filled on a temporary basis by an
employee whose existing classification is a lower rank,
he shall be paid a salary which is 5% above his then
existing salary commencing with the first shift worked
in the temporary assignment, provided that the employee
is fully qualified to perform all the duties of that
rank. Selection may be made from the promotional list,
or qualified acting list.
"Trade of shifts shall not be allowed where such trading
may result in overtime compensation for either of the
employees involved, unless such trading is expressly
authorized by the Department Head."
SECTION 3. Paragraph (e) of Section IX of Resolution
No. 1277 is amended to read as follows:
(e) "In the Fire Department all employees classified as Fire-
fighter., Fire Engineer, Fire Captain, and Fire Battalion
Chief, will serve on the 3-platoon system; each platoon
is required to work 121.75 regularly scheduled shifts
per year, and every shift is composed of 24 hours.
"Each Fire Department employee in these classes is,
therefore, required to work a stated total of 2922 hours
per year (56.19 hours per week).
"For purposes of equating vacations, holidays, sick
leave, and similar benefits related.to stated working
time, it is the policy of the City that the ratio between
general City employees and Fire platoon employees shall
be determined by using a 1 to 1.5 factor; provided, however,
that the base hourly rate for overtime purposes shall be
computed by multiplying the monthly base salary by twelve
and dividing said product by 2922."
SECTION 4. Section XV of Resolution No. 1277 is amended
to read as follows:
"Section XV. Jury, Duty; Witness Leave
(a) No deductions shall be made from the salary of an
employee while on jury duty if he has waived or
• remitted to the City the fee for jury duty. If
he has not so waived or remitted the jury fee, he
shall be paid only for the time actually worked in
his regular position. An employee accepted for
jury duty shall immediately notify his department
head in writing whether or not he waives or remits
his.jury fee to the City.
(b) A professional fire employee who is subpoenaed or re-
quired to appear in -court as a witness on job related
matters -shall be deemed to be on paid leave of absence,
while actually in court. Any notification of such
appearance shall immediately be reported to the duty
Battalion Chief. The employee shall remit to the
City Treasurer -.all fees received except mileage.
SECTION 5. Paragraph (i) of Personnel Rule XIII,93 (Resolution
No. 1276) is amended to read as follows:
(i) "Notwithstanding any provision in the Section, any time
limit or stage of procedure specified in this section may
be waived upon consent of all parties involved. Further,
if the grievant is a professional fire employee, he may
appeal the findings and determinations of the Personnel
Board to the City Council. The,City Council shall be
the final and determining appellate • authority within th-e parameters of the procedure provided for herein relative
to grievances filed by professional fire employees."
SECTION 6. Pursuant to the memorandum of understanding
with the West Covina Firemen's Association, Section 1 of this reso-
lution.shall be effective as of the first pay period in July.
Sections 2, 3, 4, and 5 shall be effective as of the first pay
period in September.
SECTION 7. The City Clerk shall certify to the adoption
of this resolution.
