A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA AMENDING UNCLASSIFIED
USE PERMIT NO. 71, REVISION 5 (AMENDMENT)
(B.K.K. COMPANY) (AS ADOPTED BY CITY COUNCIL
RESOLUTIONS NO. 4919, 5040 AND 5211).
• WHEREAS, the City Council has proposed amendments to
Unclassified Use Permit No. 71, Revision 5 (Amendment)and,
after notice and hearing, has determined that the public peace,
health and safety require the adoption of said amendments;
NOW, THEREFORE, the City Council of the City of West
Covina does resolve as follows:
SECTION 1. Unclassified Use Permit No. 71, Revision 5
(Amendment), as adopted by City Council Resolutions No. 4919,
5040 and 5211, is hereby .further amended, and as so amended, is
readopted in its entirety to read as set forth in Exhibit A
attached hereto and,by this reference, incorporated herein.
Said Exhibit A is entitled "Conditions of Approval for Unclassi-
fied Use Permit No. 71, Rev. 5 (Amendment) (The B.K.K. Company)".
SECTION 2. The City Clerk shall certify to the adoption
of this resolution.

imately 2,000 feet north of Amar Road on approximately 583
acres of .Land zoned for sj.ngle family residences and approved
for use as a sanitary landfill under Unclassified Use Permit
No. 71.
2. SUBMITTAL OIL MASTER DEVELOPMENT PLAN
Unclassified Use Permit No. 71, Rev. 5 (Amendment) shall become
null and void if a Master_ Development Plan has not been
submitted to the Planning Commission within six (6) months of,
the date said UUP is approved by the City Council.
Said approved Master Development Plan shall be transmitted
for review to the City Council and shall be subject to the
appeal period and procedures of the Unclassified Use Permit
provisions. Time extensions for the submission of the
Master Development Plan or its approval, not to exceed a
total time of three (3) months, may be granted by the City
Council.
The adopted Master Development Plan shall be reviewed at a
minimum of every five (5) years, or more often if, in the
opinion of the City, changes in sanitary landfill technology
warrant. The Master Development Plan shall incorporate the
latest sanitary landfill technology which is determined to be
necessary for the protection of the public health, safety, and
general welfare and includes those elements listed in
Condition No. 4.
3. SUSPENSION OR REVOCATION OF UNCLASSIFIED USE PERMIT
All operations of this sanitary landfill shall be conducted
in strict compliance with all conditions of Unclassified Use
Permit No. 71, Rev. 5 (Amendment) and any violations of the
conditions of this Permit shall constitute grounds for revo-
cation or suspension of the Permit.
If any member of the public makes a complaint to the City of
West Covina or any other regulatory agency, the on -site
manager of The B.K.K. Company shall be contacted immediately.
If the on -site manager is contacted with reference to a
complaint by an agency other than the City of West Covina,
he shall immediately notify the City Manager of the City of
West Covina or his designate. An inspection shall be imme-
diately conducted on the site to determine the source of the
odor or problem.
If upon inspection of the site it is determined that a violation
to the conditions of Unclassified Use Permit No. 71, Rev. 5
(Amendment) exists, the on -site manager and all regulatory
agencies having jurisdiction shall be notified immediately
and a written notice of violation may be issued by the City
Manager. Said notice shall specify the condition(s) that has
been violated and make specific findings as to the source(s)
of the violation. Upon notification of a violation, the City
Manager of the City of West Covina (or his designate) shall

B. 1). If the source of the problem or violation is found
to be related to the handling of liquid wastes, the
site shall be immediately closed to the disposal
of liquid wastes until the appropriate
corrective actions have been completed to prevent
a recurrence of the violation.
2). If they source of the problem or violation is found
to be related to the handling of solid wastes, the
site shall be immediately closed to the disposal of
solid wastes until the appropriate corrective
actions have been completed to prevent a recurrence
of the violation.
3). If the source of the violation is found to be
escaping gases from the sanitary landfill, not,
directly attributable to new solid or liquid
wastes, appropriate corrective actions shall com-
mence and be completed within twenty, -four (24)
hours. If not corrected within this time period,
the site shall be 'immediately closed to further
• refuse disposal.
4). The operator may appeal any closure order to the
City Council. Upon the filing of such an appeal,
the special meeting will be scheduled within forty-
eight (48) hours, excluding weekends.and holidays.
5). The City Council shall make a determination based
on its findings as to the reason(s) why the closure
order was issued. The City Council may rescind the
order or continue it in effect until the condition
has corrected.
C. The City Manager may order the operator to forfeit, as a
penalty, to the City of West Covina for each day that a
violation exists to.the conditions of Unclassified Use
Permit No. 71, Rev. 5 (Amendment) according to the following
schedule:
First day violation $1,000
Second day violation 1,500
Third day violation 2,000
Each day thereafter 2,500
The operator may appeal, within ten (10) days, any for-
feiture order to the City Council. Upon the filing of
such an appeal, at its next regularly scheduled meeting
the City Council shall determine whether or not a
violation of the conditions did in fact exist. The City
Council may.rescind, modify, or confirm the forfeiture
order within the monetary limits.listed above.

3. C. All agencies having jurisdiction on the site shall 'be
(Con't) notified of the- Complaint-, the results of the investiga-
tion, the corrective action, and the final. disposition of
the compl.ii_nt. The person making the complaint shall also
be notified. Any costs .incurred by the City of West
Covina in Connection with this inspection and enforcement
shall be, borne by the operator, pursuant to Condition 10.
. 4. MASTER DEVELOPMI?NT PLAN
A Master Development Plan shall be prepared by the applicant
for the ultimate development and use of the entire 583-acre
parcel. This Development Plan shall be conceptual in nature
and shall include, but not'be limited to, the following plans �.
and studies:'
A. Engineering Geologic and Soils Study
The soils and geology studies shall be conducted by a
soils engineer, who shall be a civil engineer holding
a valid certificate of registration issued by the State
of California. These studies shall include appropriate
maps, drawings, photographs, calculations, test reports,
etc., to determine the foundation conditions of the proposed
landfill area. These studies shall also include an analysis
of the stability of the proposed slopes-; recommendations
for controlling surface and subsurface water run-off. .
B. Aesthetics
The Master Development Plan shall retain as many as.possible
of the natural slopes facing outward and immediately
adjacent to the boundaries of the subject property.
These slopes provide a physical and visual screening of
the landfill operation from adjoining properties.

All finished slopes and ridge lines shall be molded and
undulating to retain as much as possible of the natural
character, quality, and appearance of the terrain in
this area. These slopes shall be planted in compliance
with the Hillside Ordinance within sixty (60.) days after
they become visible from outside the boundaries of the
subject property. Said planting shall be subject to
the approval of the Planning Director..
C. Landfill Setback (Safety Zone)
A minimum setback of 100 feet shall be established from
property lines to the base of any artificial landfill.
Additional appropriate setbacks may be required if
geologic and soils studies indicate a hazardous situation.
This setback is to provide a safety zone which may be
used for gas and ground water monitoring system and to
provide area for remedial measures as required..
D. Capacity of Landfill
The total capacity of the landfill shall be calculated
based upon the final elevation's of the approved Master
Development Plan. The landfill shall be deemed completed
within thirty .(30) years, or when the.Master Development
Plan elevations are reached, whichever is sooner.

date of this Unclassified.Use Permit, it has become

ConceptuaA Gradit�� PJarA is a schematic plan showing
eXis-t.tn� and final elevataoms, It shall include a
t.eritative OperatIona.ls Plan of cut and fill for the
anticipated 30-yeas life of this Permit. The Conceptual
Grading Plan shall be developed subject to the following
criteria:
1).. Final grade and design to be approved by the
geologist and soils engineer.
2). At the end of each working day, the day's deposit
shall be covered by a layer of earth equivalent
to one (1) foot of compacted cover.
3). Final cover material shall be a minimum of three
(3) feet in depth. In no case shall any permanent
excavation reduce the final cover to less than
three (3) feet in depth.
4). Ultimate slopes shall be constructed to a ratio
of one (1.) foot of rise to two (2) feet of horizontal
distance. The fill slopes shall have a minimum
face cover of fifteen (15) feet measured horizontally,
and consist of inert earth material.
5). The design of the Grading Plan shall provide for
. the continuation of the existing drainage patterns
to the extent that there shall be no diversion of
run-off onto properties adjacent to .the subject site.
F. Access and Circulation
1). Access to the Sanitary Landfill
Access to the sanitary landfill operation shall be
limited to one (1) approved location on Azusa Avenue
as,approved on the Three -Year Operation Plan as set
forth in Condition No. 11.
2). Major Road System
(a). Alignment of a scenic highway (Fairgrove
Avenue) shall be established on natural soil
or solid fill (inert material) only, along
the northerly ridge line of the subject
property from Azusa Avenue to the easterly
property line. The landfill operator shall
prepare a plan and profile to scale 1"-200'
for the subject section of Fairgrove Avenue,
to be submittted for approval to the office
of the City Engineer.
The applicant shall rough grade Fairgrove
Avenue to within one (1),�foot of the section
and grade as shown on the approved plan and
profile referred to above. Said grading shall
be completed by the operator prior to the com-
pletion of the landfill operation or at such
time as the City schedules and funds a project
to install this street. The operator shall

acquire .fee title to the subject property.
(b) . Alignment for Nogales Street shall be estab-
lished on natural soil or solid fill (inert
material) only, from its terminus on the
southerly property line to the scenic ridge
route (Fairq.rovc Avenue) . The landfill operator
shall prepare plan and profile to scale
1"=200' for the subject section of Nogales
Street, to be submitted for approval. to the
office of the City Engineer.
The applicant shall rough grade Nogales Street
to within one (1) foot of the section and grade
as shown on the approved plan and profile re-
ferred to above. Said grading shall.be com-
pleted by the operator prior to the completion
of the landfill operation or at such time as
the City schedules and fundsa project to in-
stall this street. The operator shall also
offer the dedication of the right-of-way for
Nogales Street at such time as he may acquire
fee title to the subject property.
3). Secondary Road System
Circulation within the area shall take access from
the major road system including Azusa Avenue, but not
including the sanitary landfill access location on
Azusa Avenue. Rough grading of the road system shall
be provided by the operator.
• 4). Service Road System
Operator shall provide for a network of service roads
for use by maintenance vehicles, adequate to serve
any use of the final surface and slope areas. Service
roads necessary for the maintenance of the landfill
slopes, etc., shall be improved with a minimum of
four (4) inches of Class 2 aggregate base material
to a width of twelve (12) feet, by the landfill
operator.
G. Master Plan of Drainage
A Master Plan of Drainage shall be designed to include all
surface run-off. The major system shall start at the
easterly boundary of the property and run westerly,along
the southerly boundary of the property., to Azusa Avenue.
All facilities shall be designed and constructed in -accord-
ance with Los Angeles County Flood Control standards.
H. Water and Sewer System
1). Schematic Plan for Water System
A schematic plan for a water system shall include
domestic, irrigation, and fire protection for the
entire area of the subject property
2). Schematic Plan for Sewer System
A schematic plan for a sewer system shall be pre-
pared for all facilities shown on the Land Use
Plan that.would require such services.'

3). The schematic landscaping plan shall comply with
the hillside Ordinance.
Emphasis shall be placed on developing a list of
trees, shrubs and ground cover material which are
• drought resistant, fire resistant, and compatible
with the sub -surface condition of the landfill.
4). Any use of the 583-acre landfill site, or any.
portion thereof shall include the total site and be
rev.iewed.on the basis.of.the interrelationship
between all uses on the site.
J. Gas Recovery System
A Master Dian for a Gas Recovery System shall be designed
to recover_ the gases generated by the decomposition of
material in the sanitary landfill. The system shall
include facilities to dispose of the captured gas in a
manner approved by the City of West Covina and the
Southern California Air Pollution Control District.
This system shall be installed in existing. dump sites
"B" and "D" and all future dump sites. The Master Plan
for the Gas Recovery System shall be submitted to the
City for review and app.roval'within six. (6) months of
date of approval of Unclassified Use Permit No. 71,
Rev. 5 (Amendment) and be installed within eighteen (18.)
months of the date of approval of the Unclassified Use
Permit.
• 5• ULTIMATE SAFETY CLAUSE
The owner of the 583-acre property which contains the sanitary
landfill site shall be responsible for the maintenance of.the

landfill site in perpetuity. Said maintenance includes:
A. Correction and prevention of fissures in the landfill
surface and slopes.
B. Correction and prevention of erosion of the landfill
surface and slopes.
C. Correction and prevention of gas and/or water migration
into the underground water table or to any area beyond
the site boundaries.
D. Correction and prevention of any odors emanating from
the landfill site.
E. Correction and prevention of any other circumstances
that, in the opinion of any agency having jurisdiction,
may endanger.the health, safety or general welfare of
the community.
F. The owner of the landfill site shall provide funds pursuant
to Condition No. 10 which will guarantee the maintenance
of the site as provided in this condition. Within ninety
(90) days of the approval of this Permit, the necessary
document(s) shall be recorded by.the applicant to give
constructive notice to all subsequent.property owners
of this landfill site that:
1). The subject property is subject to the terms and
conditions contained in Unclassified Use Permit
No. 71, Rev. 5 (Amendment) and any subsequent ,r
• amendments.
2). The owner of the 583-acre property which contains
the landfill is responsible for the perpetual
maintenance of the site and must comply with the
financial obligations contained herein.
3). The current and subsequent property owner forever
hold the City of West Covina free and clear of any.
responsibility for the maintenance or operation of
the landfill site.
6. VALIDITY.OF CONDITIONS
It is hereby declared that if any conditions or limitations
of this Permit .are held to be invalid,,that holding shall
not invalidate any of,the remaining conditions and limitations'';',''c
of this Permit.
7 . LETTER .OF ACCEPTANCE
The land owner and landfill operator, or their bona fide
representatives, shall file a letter accepting all of the
conditions of,this Unclassified Use Permit within thirty (30)
days of final approval of the Unclassified Use Permit. Failure;
to comply with this condition renders.this Unclassified Use
Permit'nul:1 and void.
8. MODIFICATION OF CONDITIONS
The City of West Covina may call a public hearing to modify
any requirement of this Unclassified Use Permit, if it is
determined that conditions have changed requiring modifications
or additions to the conditions as set forth herein.

9. SCALE MODEL
Prior to the Planning Commission's review of the Master
Development Plan, the landfill operator shall furnish the
City a 1"=200' scale, three=dimensional topographic and
development model of the property which will show the
following:
A. Existing terrain.
B. Final configuration of landfill as per the Master -Develop-
ment Plan and any revision of same.
10. FEES AND FINANCIAL OBLIGATIONS
A. The City Council shall establish an administrative and
inspection fee which shall be paid to the City of West
Covina in an amount sufficient to reimburse the City for
its actual expenses incurred for inspection of the
operation of the sanitary landfill and the enforcement
of the Unclassified Use Permit. The operator shall pay
to the City annually, before the first day of July, an.
amount equal to the City's actual costs for such services
in the preceding year.
Any additional costs incurred by the. City during the
annual year in responding to specific complaints,
problems, etc., shall be borne by the operator. A1.1
of these fees shall be paid to the City prior to the
issuance or renewal of a business license.
B. On July 1, 1976, the operator shall post a $100,000 bond
in a form to be approved by the City Attorney to guarantee
the maintenance of the landfill site. Said bond shall
be fora term of one (1) year and shall be renewed on
July 1, 1977, for the following fiscal year. If the
State of California adopts legislation that provides a
fund for the maintenance of the landfill (see Condition
No. 5), the abovementioned bonds shall be released on
the effective date of that legislation. If after two (2)
years this legislation is not adopted and effective, the
operator shall deposit with the City of West Covina
$5,OOO on July 1, 1978, and on July 1st of each subsequent
year, with the last $5,000 payment due July 1, 1988;
$10,000 beginning on July 1, 1989and on July lst of each
subsequent year, ending on July 1, 1993, up to a maximum
Of $100,000, to provide a fund to guarantee the maintenance
of the landfill site in perpetuity.
All such funds shall be deposited in a special purpose
account to be available to reimburse the City for the
costs of remedial work required to protect the public
health, safety and welfare.
All interest derived from such funds shall be retained in
the special purpose account. The special purpose account.
shall be established in a mutually acceptable fiduciary
in perpetuity. Funds from the special purpose account

10. B. shall be withdrawn by the City to pay for remedial work
(Con't.) only if the operator or property owner has failed to do
{, the remedial work required by the City and has failed
to-do this work in a reasonable time, as determined by
the City Engineer.
If State legislation becomes effective that provides
• a fund for the perpetual maintenance of the landfill,
all funds in the special purpose account shall be
refunded to the depositor.
C. The City Council of West Covina shall establish
maximum fees, rates, and charges by resolution, ordinance,
or agreement with the landfill operator.
D. The City of West Covina shall be held harmless of any
claims filed that pertain or are related to the landfill
operation or the maintenance thereof. The current and
subsequent property owner shall include the City of West
Covina in their insurance policy to guarantee the City's
hold harmless status. The current and subsequent property
owner shall be totally responsible for any claims filed
that pertain or are related to the landfill operation or
.the maintenance thereof.'
11. THREE-YEAR OPERATIONAL PLAN

• areas proposed to be filled during the following three
(3) years including projections of ant=.icipated liquid
and solid waste volumes.
B. Statement of geologic and soils problems that may be.
encountered, if any, and proposed remedial measures
that will be taken.
C. Plan for those areas ;subject to temporary erosion control
including a timetable for installation with the type and
quantities of materials to be used.
D. Plan for landfill operation during inclement weather.
E. Areas designated for interim landscaping including a
schedule for installation with a list and quantities of
materials to be used.
F. Final grades for those areas where landfill operations
will be completed during the following three (3) years.
.G. Plans covering those improvements of a permanent nature
including but not limited to roads, drainage devices,
permanent landscaped slopes, etc., to be constructed
during each of the following three (3) years.
• On or before December 15 of each year, the landfill
operator shall furnish the City with a faithful perform-
ance bond for all permanent improvements in an amount to
be.determined by the City Engineer. This bond shall be
accompanied by an appropriate agreement satisfactory to.
the City Attorney to cover the City°s right of entry to
complete the improvements.
.12. ACTIVITY REPORTS
A. Monthly Activity Reports
The landfill. operator shall be required to submit monthly
activity reports on refuse tonnage and industrial waste
to the City Engineer. This report shall include:
1). Total number of loads.
2). Total tonnage.
3). Number of industrial waste loads.
4). Estimated gallonage.
5. Gross receipts by category of charges for materials
• entering the site.
B. Annual Activity Report
The landfill operator shall submit an annual activity
report by March 1 for the previous calendar year to the
City Engineer. The annual report shall contain:

4). Copies of any and a11, annual reports submitted to
other agencies including, but not limited to,
Water.Quality Control Board, Air Pollution Control
District, Countv Health. Department, and State Health
Department. A report shall be included which states
actions taken to remedy and deficiencies noted by
these agencies.
5). A report covering any accidents and safety hazards
that occurred during the previous year, to include
information with respect to remedial actions taken
in these matters. Copies of all reports sent to
the State Division of Industrial Safety shall be
attached to this report.
6). The amount of available cover material shall be
reviewed to ensure sufficient amounts to provide
the required final cover and to comply with the
final grading plan.
13. MEASUREMENT OF PERFORMANCE
A. Waste Landfill Measurements
Scales shall be installed which are adequate in size
to determine the weight of all material to be disposed
of on the landfill site (scale to the approved by.the
City Engineer).
Complete and adequate records of the daily weight
received shall.be kept and maintained by the operator,
and shall be available to the City Engineer.or his
authorized agent at all reasonable times during business
hours.
B. Survey Monuments
The landfill operator shall construct and maintain monu-
ments and bench marks as shown on approved plans, as the
City Engineer may require, for reference and control of
operations as the work progresses.
C. Gas Monitoring
1). The landfill operator shall install .and maintain a
gas monitoring system along the boundary of the
landfill, adequate to detect any migration of gas
from the site. A plan showing the layout of such a
system shall be submitted to the City Engineer for
his review and approval.
2). Field readings of the gas monitoring system shall
be made at least monthly by use of an explosimeter.
Records of these readings.shall be sent to the City
..Engineer as part of the Monthly Activity Report.

D. Ground Water Monitoring
The landfi 11 operator shall install and maintain water
wells for the purPos� of ground water monitoring, in
accordance wi. til standards and procedures prescribed by
the California Regional. Water Quality Control Board,
A copy of the plan showing the ground water monitoring
system and copies of all readings, reports, etc. sub-
mitted to the Regional Water Quality Control Board shall
be sent to the City Engineer.
14. WATER POLLUTION CONTROL
A permit shall be obtained from the Regional Water Quality
Control Board. All provisions and conditions set forth in
this permit shall be complied with during the operation of
the landfill.. Such permit shall be made a part of this
Unclassified Use Permit. Copies of all reports sent to the
Regional Water Quality Control Board pursuant to the approved
Waste Discharge Requirementsfor B.K.K. Sanitary Landfill shall
be sent to the City Engineer.
15. AIR POLLUTION CONTROL
Landfill operator shall abide by all rules and regulations
of the Air Pollution Control District. Such rules -and
regulations shall be made a part of this Unclassified Use
Permit.
• 16. CERTIFIED SANITARY ENGINEER
All. plans included in the Master Development Plan and the
operational Plan shall be reviewed and signed by a civil
engineer who.is registered in the State of California, and
who is experienced in sanitary engineering and acceptable to
the City Engineer and landfill operator, All costs to be
borne by the landfill operator.
17. FLOOD CONTROL REQUIREMENTS
A. Adequate provisions shall be made to carry-all.storm
run-off from the landfill area into the master drainage
system in a mariner which will minimize its percolation
through the deposited material and/or .prevent erosion.
B. Adequate provision shall be made to intercept storm
run-off from areas adjacent to this landfill operation,
and to divert such run-off in a.manner which will
prevent its percolation through the disposed material
and/or prevent erosion.
C. All plans for.temporary drainage facilities shall be
submitted to the City Engineer for approval as part of
the Three -Year Operational Plan.
18. MODE OF OPERATION
The mode of operation shall be in conformance with the standards
and policies ofthe State of California.

19. WASTE MONITORING AND DISPOSAL
Wastes accepted for disposal shall be in accordance with the
conditions and requirements prescribed by the Regional Water
Quality Control Board, and by the State Water Resources
Control Board's Waste Discharge Requirements for Waste Disposal
to Land as adopted March 2, 1972, and subsequently amended.
The operator shall develop a procedure to monitor incoming
• loads and their disposal on the site. This procedure shall
include, but not necessarily be limited to, explosivity, ph,
temperature, and odors.
A log book shall be kept and entries shall be made of all
incoming hazardous solids and all liquids. The log book shall
be easily identifiable and made available to City personnel
at all times. The log shall include: the date and time of.
receipt; the results of the liquid waste sampling; the
disposal location. A map showing the location where different
types of liquids and hazardous solids are deposited shall be
maintained with the log book.
This procedure shall be submitted to.the City Engineer within
thirty (30) days of the approval of Unclassified Use Permit
No. 71, Rev. 5 (Amendment). This procedure shall be reviewed
and approved by the City Engineer.'
20. OPERATIONS MANUAL
The operator shall develop an operations manual to monitor
incoming.waste loads and safely dispose these wastes.on.the
landfill site. This manual shall..include but not necessarily
be limited to:
A. Hours of Operation.
B. Waste.Monitoring and Disposal Procedure.
C. Interim Cover Requirements.
D Emergency..Plan to respond to fire, security, odor, and
on -site injuries that occur on the site.
E. Inclement Weather Procedures.
F. Site Maintenance and Erosion Control requirements and
procedures, including litter control.
G. Waste Discharge Requirements of the Regional Water
Quality Control Board which are applicable to the landfill.
This manual shall be submitted to the City Engineer within
thirty (30). days of the approval of this Permit. It.shall. be
reviewed and approved by the City Engineer.
21. INDUSTRIAL WASTE
Any portion of the site designated for Class I materials by
the Regional Water Quality Control Board shall be operated
in strict conformance with conditions and requirements
• prescribed by the Water Quality Control Board resolution.
and those contained in this,Unclassified Use Permit with the
more restrictive having precedence.
Such resolution shall be made a part of.this Unclassified
Use Permit.
A. The City Engineer shall be informed by.the landfill
operator of any application for any revision of boundaries

21, A. and/or modification of conditions for the Class I
(Con't.) disposal areas.
B. There shall be no nuisance created by odors as a result
of this disposal site.
C. Liquid waste deposited in the site may be ponded during
those regular operating hours specified in Condition No. 33.
All liquids not deposited in wells shall be spread and
. mixed with soil and refuse and covered before sundown each
day. Covered landfill material that has been in place
more than two (2) days shall not be exposed to permit the
disposal of liquids or any other refuse material.
D. In addition to monitoring and sampling required by the
Water.Quality Control Board, the City Engineer may require
the landfill operator to provide samples of material being
deposited to verify their content.
E. Incoming loads shall be limited to a maximum ratio of one
liquid waste_ load to two solid waste loads by weight per month.
F. At the end of any working day, all free liquids or moisture
shall be completely covered.
G. Disposal of liquid waste in wells may be permitted,
provided.no odor, nuisance, or health hazard is created
by said disposal method.
H. All odorous liquids shall be disposed of in wells. All
odorous solids shall be covered by soil and refuse
immediately after disposal in order to prevent the
escape of odors.
22. SALVAGE
Salvage operations, out of off -site public view by either
topographic barriers or a decorative fence, shall be allowed
on an area not to exceed one -(1) acre; shall be restricted to
one (1) location during any period of time; and shall be
during the hours of operation of landfill. activities only.
No retail or wholesale activities may be conducted on the
subject property.
23. INSPECTION
The landfill and its associated operations and records shall
be open and accessible for inspection by the City Engineer
of West,Covina, his 'representative, or the representative of
any interested public agencies.
The City of West Covina may conduct or contract for regular
on -site inspections at any interval deemed adequate by the
City Engineer. The cost of said inspections shall be borne
by the operator of the landfill and guaranteed pursuant to.
Condition No. 10.
This inspection option will be void when other inspection
standards and methods are adopted by the State and said
standards and methods are equal to the above inspection
• method in the opinion of the City Engineer.
24. SLOPES
Slope design shall comply with the Grading Ordinance of the
City except when modified by the City Engineer and shall include:
A. Service roads as required for slope maintenance.

24. B. Planting with ground cover compatible with that native
to the general area.
C. Terraces, including drainage devices, shall be constructed
in accordance with criteria established by, the Soils
Engineer. The maximum vertical interval between terraces
shall be twenty-five (25) feet.
D. Ultimate slopes shall be constructed no steeper than two
• (2) feet horizontal to one (1) foot vertical. .
25. FINAL COVER
Final cover material shall be a minimum of three (3) feet in
depth. A depth of cover, adequate to support tree growth
(as determined by the City Engineer) shall be provided in
those areas designated on the landscaping plans as sites for
future trees.'
26. EQUIPMENT
A. Equipment to be used in this sanitary landfill operation
shall comply with all ordinances, laws, and regulations
pertaining to safety and licensing and all State Indus-
trial Safety Standards.
B. Sufficient equipment, in good operating condition, shall
be available on the premises at all times to properly
conduct operations in accordance with conditions of the
Unclassified Use Permit. All such equipment shall be
muffled to the satisfaction of the City Engineer.
C. Said equipment shall be equipped with lights to permit
the compliance with Condition No. 33. Alternate lighting
methods may be.us4d by the operator subject to the approval
of the City Engineer.
27. SECURITY
A. The entrance to the landfill site shall be manned at all
times during working hours, and shall be gated and locked
after working hours.

B. All equipment shall be secured and parked on level terrain
after working hours.
C. The landfill operator shall arrange with the City Engineer
to.have a responsible person or persons notified in the
case of emergencies occurring during and after working hours.
OPERATIONAL CONDITIONS
28. POSTING OF UNCLASSIFIED USE PERMIT
A copy of this Unclassified Use Permit and the current
Operational Plan shall be displayed in a protected visible
location at the entrance to the subject property, and made
available at all times for reference use of all interested
• parties.

29. RECORDS AVAILABLE FOR INSPECTION
All records related to the sanitary landfill shall be main-
tained and made available on call to the City Engineer and
other governmental agencies.
30. RESPONSIBLE PERSONNEL
The landfill operator shall provide a minimum of two responsible
• employees on the site to inspect and monitor incoming loads,
and be responsible for the correction of any problems set
forth in Condition 19. One employee shall be designated as the
site manager or supervisor and shall be responsible for the
overall supervision of the landfill site and operation. The
responsible employees shall be on the site during all hours of
operation. One shall be stationed at the gate house to inspect
incoming loads and the other shall be stationed at the site
where waste materials are being deposited.
At all other times, gates shall be closed and securely locked
and no access to the property permitted. The landfill operator
shall advise the City Manager in writing as to the name(s),
address(es), and telephone number(s) of the responsible employees
who are authorized to be in charge of the operations.
31. SALE AND LEASING
In the event the landfill site is sold or leased prior to the
expiration date of this Unclassified Use Permit, the City
Engineer or City Manager of West Covina shall be notified
at least thirty (30) days prior to the date of sale or leasing.
In addition, the buyer or lessee shall file with the City
of West Covina an affidavit that he is aware of the obligations
of this Unclassified Use Permit, and that he accepts all such
• obligations with the understanding that they may subsequently
be amended by action of the regulatory agencies', including
the City of West Covina.
32. BUSINESS LICENSE
Permittee shall at all times possess a current and valid
business license issued in accordance with the City of West
Covina's Business License Ordinance, while operations are
being conducted under this Permit. Said business license
shall be promptly renewed, and any delinquency in this
respect shall constitute sufficient grounds for immediate
suspension of this.Permit.
33. HOURS OF OPERATION
The depositing of waste and refuse on the site shall only be
permitted during the following schedule of hours:
Solid Waste Materials 6:00 a.m. to 6:OO p.m.
Liquid Waste Materials 6:00 a.m. to 5:00 p.m.
In any event, all depositing of solid and liquid waste will
cease at one (1) hour before sunset to permit daily cover to
be completed before sunset. If completion of the daily cover
operation extends beyond one (1) hour after sunset, the operator
• shall provide safety lighting in the vicinity of the working face
and direct illumination of the working face to provide for the
safety of working and inspection personnel and insure the
completion of the daily cover.
34. SIGNS
A. A sign or signs approved by the City Engineer and
Planning Director shall be posted at every entrance to
this facility. The sign shall contain the following

colors as to be read without difficulty by a person
with normal vision at a distance of 100 feet.
1). Name of facility.
�1 Scheilu�e of days and hours when the facility
will. be open to the public.
3). Any other information considered essential or
pertinent by the Permittee and/or the City
Engineer and Planning Director.
B. A schedule of prices shall be posted at the entrance
and a convenient turn -around shall be available at
said location:
C. No other signs shall be permitted on the premises except
directional and.regulatory signs required and/or approved
by the -Planning Director and City Engineer.
35. SANITATION AND HEALTH REQUIREMENTS
A. All buildings.required under the plans and specifications
and conditions of this Unclassified Use Permit shall be
constructed and maintained in such a manner as to prevent
rodent harborage.
B. Any rodent infestation shall be immediately controlled
by the proper use of poison, traps, or gas to the
satisfaction of the County Health Officer.
C. An approved drinking water supply shall be provided
and maintained on the premises.
• D. Toilet facilities shall be provided and properly main-
tained as required by the County Health Department for
the use of employees and all other persons who have
business.on the premises.
E. The landfill site shall be operated so as not to endanger
the public health. The Public Health Officer of West
Covina, or an authorized representative of the City.of
West Covina, shall have free access to the landfill site.
36. FIRE PREVENTION AND AIR POLLUTION REQUIREMENTS
A. A water supply system for fire fighting and other purposes
shall be constructed as shown on the approved plans and
maintained and operated to the satisfaction of the City
Fire Department.
All water tankers used on -site by the operator shall be
equipped with connection fittings approved by the West
Covina Fire Department to permit the filling of the water
tankers without delay and shall be' made available for
fire suppression.
B. A cleared area, not less than twenty-five (25) feet
wide, shall be maintained around the entire dumping
area free of weeds, grass, or other combustible material.
• This condition shall not apply outside of the area
covered by this Permit.

C
36. C. The ground shall be maintained free of flammable material
for a distance of fifteen (15) feet on each side of the
access roads as shown on approved plans.
D. "No Smoking" signs shall be posted on the premises, and
smoking regulations shall be strictly complied with as
required by the City of West Covina Fire Department.
E. No burning of any kind shall be permitted in connection
with disposal operations at this site. Any fire which
may occur on the premises, or any underground smoldering,
shall be immediately reported to the Fire Department
and to the City Engineer by the person in responsible
charge of operations. In addition, it shall be the
responsibility of the Permittee to immediately extinguish
.any such fire or underground smoldering to the satisfaction
of the Fire Department and the City Engineer.
F. The operator shall provide the emergency use of.bull-
dozers and dirt haulers for fire extinguishment.
Current phone numbers of personnel on emergency call
to operate this equipment shall be provided to the
City of West Covina.
37. PUBLIC USE OF FACILITY
This waste disposal facility shall be maintained for the benefit
of the general public and while open to the public, the operator
shall not refuse to accept materials from anyone, provided the
materials can be.accepted for disposal under the terms of this
Unclassified Use Permit and the party disposing of the material
pays the applicable disposal charge. Commercial haulers who are
delinquent in payment of accounts may be barred from use of the
landfill at the discretion of the operator provided the City
Engineer is notified twenty-four (24) hours.prior to such an
action.
38. LANDFILL ACCESS ROADS
A. Access to the landfill operation shall be taken exclu-
sively from Azusa Avenue'.
B.' Only those access roads designated by the Operational
Plans shall be used in reaching the landfill site.
C. The access road from Azusa Avenue and the area within
150' of the weighing station is to be paved with an
asphaltic surfacing as approved by the City Engineer,
.and extend one-half ().mile into the landfill area.
This is to eliminate the transfer of mud and dirt onto
Azusa.Avenue. It shall be swept free of dirt and
debris, and shall be kept free of potholes at all times.
D. An all-weather road to the specifications of the City
Engineer shall be constructed and maintained from the
weighing scale to the inclement weather landfill area.
