RESOLUTION NO. 5237
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA APPROVING PRECISE PLAN OF DESIGN
NO. 263, REVISION 7, AND APPROVING A PORTION OF,
AND DENYING A PORTION OF, VARIANCE NO. 725

The City Council of the City of West Covina does resolve
as follows:
SECTION 1. The City Council does hereby find and determine
that there was filed with the Planning Commission the application
of S. S. Kresge Company for the approval of a precise plan of
design for the remodeling of an existing department store and
appurtenant facilities on an 11.678 acre parcel of land being a
portion of E. J. Baldwin's Fourth Subdivision, M. B. 8-186, located
on Orange Avenue between Cameron Avenue and West Covina Parkway in
the Regional Commercial (R-C) Zone, and for certain variances from
development standards of the Regional Commercial Zone, that hearings
thereon were duly conducted by the Planning Commission and the
Planning Commission approved the precise plan of design subject to
certain conditions, and granted the variances requested except for
the variance for the amount of landscaping and a fully automatic
irrigation system, that the refusal of the Planning Commission to
grant the variance for the amount of landscaping and the fully
automatic irrigation system was appealed to the City Council, and the
City Council held a hearing thereon and proper and legal notice of
the hearing was duly given.
SECTION 2. Precise Plan of Design No. 263, Revision 7,
• is hereby approved pursuant to the provisions of the West Covina
Municipal Code provided that the physical development of the property
included therein shall conform to said plan and each and all of the
conditions of precise plan approval contained in Planning Commission
Resolution No. 4-76-2653 which resolution is, by this reference,
incorporated herein and made a part hereof.
Except as otherwise expressly indicated in Planning Com-
mission Resolution No. 4-76-2653 and this resolution, each and
every one of the conditions contained in said resolution and in
this resolution shall be fully performed and'completed or shall be
secured by bank or cash deposit satisfactory to the Planning Director
before the use or occupancy of the property is commenced and before
a certificate of occupancy is issued. The violation of any of the
conditions contained in said Resolution No. 4-76-2653 or this reso-
lution shall be grounds for the revocation of Precise Plan of Design
No. 263, Revision 7, by the Planning Commission or City Council.
SECTION 3. The variances from the development standards,
as contained in Variance Application No. 725 are hereby granted
except that the variance requested for a reduction in the amount of
landscaping is disapproved and a manual or other suitable method
of irrigation may be substituted for an automatic sprinkler system
provided that a bond or other method of guaranteeing the maintenance
of the landscaping shall be submitted to and approved by the Plan-
ning Director.
The City Council hereby finds that the granting of a
variance from the requirements for a three foot high wall on the
periphery of the parking lot,'the total screening of roof top equip-
ment and the modification of the requirement for the installation
of parking lot lighting of the type found in the Civic Center will
not be materially detrimental to the public welfare and will permit
the upgrading of the property and the elimination of a substandard
development.

The granting of a variance will not adversely affect the
General Plan.
SECTION 4. The City Council hereby finds that the improve-
ment project for which the variance is granted is categorically
• exempt under the provisions of the California Environmental Quality
Act of 1970.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
