A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA RESTRICTING THE RIGHT OF THOSE
CITY EMPLOYEES WHOSE DUTIES CONSIST PRIMARILY
OF THE ENFORCEMENT OF STATE LAWS OR CITY
ORDINANCES TO FORM, JOIN OR PARTICIPATE IN
EMPLOYEE ORGANIZATIONS.
• WHEREAS, Section 3508 of the Government Code authorizes
the City Council, after a public hearing, to limit the right of
those City employees whose duties consist primarily of the enforce-
ment of State laws or City ordinances to form, join or participate
in employee organizations which are composed solely of such peace
officers and which concern themselves solely and exclusively with
the wages, hours, working conditions, welfare programs and advance-
ment of the academic and vocational training in furtherance of the
police profession and which are not subordinate to any other organi-
zation;
NOW, THEREFORE, the,City Council of the City of West
Covina does resolve as follows:
SECTION 1. After written advance notice to the West
Covina Police Association and to the peace officer employees of
the West Covina Police Department and after a public hearing on
the matter, the City Council does hereby find and determine that
the actions and activities of police officers in the enforcement
of State law and City ordinances can be affected by the employee
organizations to which they may belong and the protection of the
public peace and safety requires that the right of such employees
to form, join or participate in employee organizations be limited
to the extent permitted by Section 3508 of the Government Code.
• SECTION 2. Those employees of'the City of West Covina
employed in the classes of captain, lieutenant, sergeant, agent,
and police officer in the Police Department of the City,
the duties of which consist primarily of the enforcement of State
laws or City ordinances, are hereby prohibited from joining or
participating in any employee organization except an employee
organization which is composed solely of such peace officer employees
and which concerns itself solely and exclusively with the wages,
hours, working conditions, welfare programs and advancement of
the academic and vocational training in furtherance of the police
profession and which are not subordinate to any other organization.
SECTION 3. Nothing in this resolution shall prohibit
those officers or employees in the Police Department who are on
the effective date of this -resolution honorary or associate members
of an employee organization consisting of peace officers employed
in the Police Department from continuing to be honorary or associate
members of that employee organization exclusively for insurance
coverage and social benefits incident to such membership.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
