A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA GRANTING AN UNCLASSIFIED USE PERMIT
(Unclassified Use Permit No. 207 - Richard & Zola
Musich).
• The City Council of the City of West Covina does resolve
as follows:
SECTION 1. It is hereby found and determined that the
application of Richard and Zola Musich for an unclassified use
permit to permit the storage of a commercial vehicle on that certain
property generally described as 3447 Hillhaven Drive in the R-1
(Single Family Residential Zone, Area District I), and more particularly
described in Unclassified Use Permit Application No. 207 was duly
made, that a hearing thereon was duly held by the Planning Commission
after legal notice thereof, that the Planning Commission denied said
unclassified use permit by its Resolution No. 2627, that said action
was appealed to the City Council and the City Council held a hearing
thereon after legal notice thereof.
SECTION 2. It is hereby found by the City Council that:
(a) There are exceptional circumstances applicable to
the property which distinguish it from other properties in the same
area in that the property is located on a corner and is separated
from the freeway access road'by a six foot concrete block wall.
(b) The granting of the unclassified use permit will not
be materially detrimental to the public welfare.
• SECTION 3. An unclassified use permit is hereby granted
as applied for in Unclassified Use Permit Applicat-ion No. 207.
It is granted upon the following conditions,'the violation of any one
of which shall be gro aids for the revocation of this unclassifed
use permit by the Planning Commission or the City Council:
a. The commercial vehicle shall be parked in the location
designated in Study Plan A, a copy of which is on file with the
Planning Commission, and shall not be parked in front of the doors
to the garage.
b. The area in which the commercial vehicle is authorized
to be parked shall be completely paved with concrete or blacktop.
C. This unclassified use permit shall be reviewed by the
Planning Commission on and after one year from the date of its
issuance and may be revoked or modified if the Planning Commission
determines that the parking of the commercial vehicle, as authorized
therein, is detrimental to the surrounding property.
SECTION 4. The City Council hereby finds that the negative
declaration of environmental impact prepared for the project has
been prepared in accordance with the California Environmental Quality
Act of 1970 and the State Guidelines and is hereby adopted by the
City Council.
• SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
