A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA DENYING WITHOUT PREJUDICE THE
APPEAL OF BUTLER/UMARK, INC. FROM THE ACTION
OF THE PLANNING COMMISSION DISAPPROVING
DEVELOPMENT PLAN NO. 11 AND TENTATIVE TRACT
• MAP NO. 28958 (Planning Commission Resolution
No. 2623).
. The City Council of the City of West Covina does resolve
as follows:
SECTION 1. The City Council does hereby find and determine
that there was filed with the Planning Commission the application
of Butler/Umark, Inc. for the approval of a development plan
identified as Development Plan No. 11 for approximately 30 acres
of land together with an accompanying tentative tract map for a
168 lot subdivision in the Planned Community Development Zone
(Woodside Village) together with an environmental impact report
supplement, that hearings thereon. were duly conducted by the
Planning Commission and the Planning Commission denied said
application and the accompanying tentative tract map, that the
matter was appealed to the City Council and the City Council held
a hearing thereon and proper and legal notice of the hearing
was duly given.
SECTION 2. Development Plan No. 11 and the accompanying
Tentative Tract Map No. 28958 is hereby denied and the action of
the Planning Commission in the adoption of Resolution No. 2623 is
hereby affirmed. The denial of Development Plan No. 11 and the
accompanying Tract Map No. 28958 is denied without prejudice
to the filing of a revised development plan and a revised tentative
tract map for the 30 acres of land proposed for development.
• SECTION 3. The City Clerk shall certify to the adoption
of this resolution.
