A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA SUBMITTING TO THE VOTERS OF THE
CITY OF WEST COVINA AT THE GENERAL MUNICIPAL ELECTION
TO BE HELD ON MARCH 2, 1976, A PROPOSITION FOR THE
ENACTMENT OF AN ORDINANCE PROVIDING FOR ADDITIONAL
• RETIREMENT BENEFITS FOR UNIFORMED EMPLOYEES (LOCAL
SAFETY MEMBERS ONLY) IN THE FIRE DEPARTMENT OF THE'
CITY OF WEST COVINA TOGETHER WITH AN INCREASE IN
THE MAXIMUM CITY PROPERTY TAX RATE IN AMOUNTS
SUFFICIENT TO PAY FOR SUCH ADDITIONAL BENEFITS.
follows: The City Council of the City of West Covina does resolve as
SECTION 1. Pursuant to Section 4019 of the Elections Code,
the City Council of the. City of West Covina elects to submit to
the voters of the City of West Covina a proposition for the enactment
of the following ordinance:
AN ORDINANCE.OF THE CITY OF WEST COVINA AUTHORIZING
AND DIRECTING THE CITY COUNCIL OF THE CITY OF WEST
COVINA TO PROVIDE CERTAIN ADDITIONAL RETIREMENT
BENEFITS TO UNIFORMED EMPLOYEES (LOCAL SAFETY MEMBERS
ONLY) IN THE FIRE DEPARTMENT OF THE CITY OF WEST
COVINA AND AUTHORIZING AN INCREASE IN THE MAXIMUM
PROPERTY TAX RATE TO PAY FOR SUCH ADDITIONAL BENEFITS.
The People of the City of West Covina do ordain as follows:
SECTION 1. The City Council of. the City of West Covina
is authorized and directed to take those actions required by
law to amend the contract between the City of West Covina and
• the Public Employees Retirement'System to provide the following
retirement benefits which are in addition to the retirement
benefits currently provided to the uniformed employees (local
safety members only) in the Fire Department of the City of
West Covina:-
(1) Use the highest annual compensation paid.to the
employee, rather than the_ highest average annual compensation
earnable by the employee during the three consecutive years
of employment immediately preceding his retirement, in com-
puting the. amount of his retirement allowance. (Option
provided by Section 20024.2 of the Government Code).
(2) Upon the death of a retired employee his surviving
spouse shall be entitled to receive fifty percent of the
member's retirement allowance during her lifetime or until
remarriage. Upon the spouse's.death or remarriage, the same
allowance shall be paid to the children of the deceased
member who are under eighteen years of age, or if there are
no minor children, to the parent of the deceased member.
(Option provided by Section 21263.1 of the Government Code).

(3) Reduce the voluntary retirement age for safety
members from fifty-five years to fifty years and increase
the retirement allowance by applying a two percent factor
rather than a one and one-fourth percent factor with a
maximum retirement allowance of seventy-five percent of
final compensation. The formula is commonly referred to
as the California Highway Patrol Formula. (Option provided
. by Section 21252.01 of the Government Code).
SECTION 2. The City Council of the City of West Covina is
authorized to levy a property tax rate in addition to the maximum
property tax rate established by law to. pay the cost of -pro-
viding the additional retirement benefits described in Section
1 hereof which increase in the maximum property tax rate shall
not exceed 12 cents per $100 of assessed value of all
taxable property in the City for the fiscal year 1976-77 and
which shall be in an amount sufficient to pay the cost of
providing such additional retirement benefits for each fiscal
year thereafter. The increase in the maximum property tax rate
authorized by this section shall be in addition to any other
increase authorized by the voters of the City or by law.
SECTION 3. This ordinance shall be adopted upon the date
that the vote upon the proposition submitting the same to
the voters of the City is declared by the legislative body
and shall go into effect ten days after that date if the
proposition receives a majority of the votes cast on it at
the General Municipal Election held on Tuesday, March 2,
1976. The increased retirement benefits described in Section
1 hereof shall be available from and after such date as may
be fixed by the City Council in the amendment to the contract
between the City of West Covina and the Public Employees
Retirement System."
• SECTION 2. For the purpose of voting on the enactment
of the ordinance set forth in Section 1 hereof, the following propo-
sition shall besubmitted to the voters of the City at the General
Municipal Election to be held on Tuesday, March 2, 1976:

A. SHALL THE ORDINANCE PROVIDING FOR ADDITIONAL
RETIREMENT BENEFITS FOR THE UNIFORMED EMPLOYEES
(LOCAL SAFETY MEMBERS ONLY) IN THE FIRE DEPARTMENT
OF THE CITY OF WEST'COVINA AND AUTHORIZING AN INCREASE
IN THE MAXIMUM CITY PROPERTY TAX RATE TO PAY THE COST
OF PROVIDING SUCH ADDITIONAL RETIREMENT BENEFITS WHICH
INCREASE SHALL NOT EXCEED 12 CENTS PER $100 OF
ASSESSED VALUE OF ALL TAXABLE PROPERTY IN THE CITY
FOR THE FISCAL YEAR 1976-77 AND WHICH SHALL BE IN
AN AMOUNT SUFFICIENT TO PAY THE COST OF PROVIDING
SUCH ADDITIONAL RETIREMENT BENEFITS FOR EACH _ _

SECTION 3. The City Clerk shall include the proposition
set forth in Section 2 hereof on the ballot for the General Municipal
Election to be held on Tuesday, March 2, 1976.
• SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
