Resolution - 5164RESOLUTION NO. 5164 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA ORDERING THE VACATION OF A CERTAIN PORTION OF ORANGE AVENUE SUBJECT TO • THE RESERVATION AND EXCEPTION OF CERTAIN' RIGHTS AND EASEMENTS. The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council .of the City of West Covina does hereby find, determine, and declare as follows: (a) That on the 14th day of December, 1970, at a regular meeting of said Council, Resolution No. 4266 was duly adopted by a vote of said Council setting the time for hearing on the proposed vacation of certain portions of West Covina Parkway and Orange Avenue located within the City of West Covina: (b) That.said area proposed to be vacated is more particularly described as follows: That portion of Irwindale Avenue, now Orange Avenue, 60.00 feet wide, in the City of West Covina, County of Los Angeles, as shown on map of E. J. Baldwin's 4th Subdivision of part of the Rancho La Puente, recorded in Book 8 Page 186 of Maps, in the office of the County Recorder of said County, described as follows: • Commencing at a point in the southeasterly line of said Orange Avenue distant along said southeasterly line North 410-15'-27" East, 85.93 feet from the westerly terminus of that certain course described as South-860-15'-27" West, 28.28 feet in deed to the State of California filed as Document.No. 5520-X in the office of the Registrar of Titles of said County; thence South 360-34'-33" East, 76.91 feet; thence southwesterly tangent to last described course, along a curve concave.northwesterly and having a radius of 47.00 feet through an angle of,1290-03'-42" an arc distance of 105.87 feet; thence westerly along a reverse curve concave southerly and having a radius of 38.00 feet through an angle of 390-03'-42" an arc distance of 25.91 feet; thence South 530-25'-27" West., 133.52 feet; thence North 360-34'-33" West., 62.00 feet to a line parallel with and distant 62.00 feet northwesterly, measured at right angles, from the southwesterly prolongation of that certain course hereinbefore described as having,a bearing and length of South 530-25'-27" West, 133.52 feet and the TRUE POINT OF BEGINNING of this description; thence North 380-35'-00" East, 71.71 feet; thence northerly, tangent to last described course, along a curve concave westerly and having a radius of 101.00 feet., through an angle of 560-35'-14" an arc distance of 99.75 feet to the northwesterly line of said Irwindale Avenue.;'thence along said northwesterly line South 410-15'-27" West, 355.84 feet to the easterly terminus of the northerly line • of Parcel 3 of deed to the State of California filed March 10, 1941 as Document No. 5187-J in the office of the Registrar of Titles of said County; thence along the easterly prolongation of said northerly line North 860-33'-52" East, 16.16 feet to said parallel line; thence along said parallel line North 530-25'-27" East, 195.12 feet to the TRUE POINT OF BEGINNING. EXCEPTING AND RESERVING THEREFROM any and all rights of .ingress to or egress from the land herein described over and across that certain curve hereinbefore described as having.a radius of 101.00 feet and that certain course hereinbefore described as having a bearing and length of North 380-35:'-00" East,71.71 feet. • Also reserving and excepting from said vacation, the permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits., cables., wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, water and incidental purposes; including access and the right to keep the property free from inflammable materials and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. C� (c) That on the 11th day of January, 1971, at a regular Council Meeting the said City Council did hold a public hearing to determine whether the said area above -described should be vacated as,a public street. SECTION 2. It hereby is found.,.determined, and declared by the City Council.of the City of West Covina, after hearing the evidence adduced, that the above -described portion of Orange Avenue within the City of West Covina is not necessary for present or prospective public street purposes and the general welfare and convenience of the City of West Covina require that the same be vacated. The said portion of West Covina Parkway above -described hereby is vacated as a public street. SECTION 3. The City Clerk shall certify to the adoption of -this resolution and cause.the same to be recorded with the office of the Recorder of the County of Los Angeles and to file all other necessary documents in order that this vacation become effective. APPROVED AND ADOPTED this 22nd day of December , 1975.
