RESOLUTION NO. 5154
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA APPROVING THE FINAL
SUBDIVISION MAP OF TRACT NO. 31472,
ACCEPTING AN AGREEMENT BY THE SUBDIVIDER
AND SURETY. BOND TO SECURE THE SAME.
WHEREAS, there has been submitted to this meeting
by the owner and subdivider thereof, a final subdivision map
of Tract No. 31472 which has been approved by the Planning
Commission -and by the.City Engineer; and
WHEREAS, there has been submitted to this meeting
a proposed agreement by the subdivider for the construction
of certain improvements within or -for said subdivision; and
WHEREAS, said proposed agreement is accompanied by a
surety bond for the faithful performance of the terms and
conditions of said agreement
NOW,. THEREFORE, the City Council of the City of
West Covina does resolve as follows:
SECTION 1. That the final subdivision map of Tract
No. 31472 submitted to this meeting be and the same is hereby
approved.
• SECTION 2. That the dedication therein offered by
and the same is hereby accepted for public use, excepting the
offer -to grant Lots 49, 50, 51, 52 and 53, subject to any
restrictions to be filed and recorded therewith; and that
the proper officers of the City of West Covina be and they
are hereby authorized.and instructed to approve said final
map on behalf of the City.
SECTION 3. That the proposed agreement by the
subdivider'in the form submitted to this meeting be accepted.
SECTION 4. That the Surety Bond No. 5543337,
presented as security for the faithful performance of the terms
and conditions of said agreement with Kent Land Company as
principals and American Casualty Company of Reading, Penn,
sylvania as surety, in the total sum of One Hundred Twenty One
Thousand Two Hundred and No/100 Dollars ($121,200), be and'
the same hereby is accepted.
SECTION 5. That the City Clerk shall certify to
the adoption of this resolution.
