Resolution - 5131RESOLUTION NO. 5131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA ORDERING THE VACATION • OF CERTAIN PORTIONS OF WEST COVINA PARK- WAY SUBJECT TO THE RESERVATION AND EXCEP- TION OF CERTAIN RIGHTS AND EASEMENTS,. The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council of the City of West Covina does hereby find, determine, and declare as follows: . (a) That -on the 14th regular meeting of said Council., adopted by a vote of'said Counci on the proposed vacation of cert Parkway and Orange Avenue locate day of December, 1970, at a Resolution No..4266 was duly 1 setting the time for hearing ain portions of West Covina d within the City of West Covina: (b) That said areas proposed to be vacated is more particularly described as follows: PARCEL I. That portion of Lot 122 of E. J. Baldwin.'s 4th Subdivision of part of the Rancho La Puente, in the City of West Covina, County of Los Angeles, .as shown on map recorded in Book 8 • Page 186 of Maps, in the office of the County Recorder of said County, described as follows: Commencing at a point in the northwesterly line of said lot, distant along said northwesterly line North>410-15'-27" East., 85.93 feet from the westerly terminus of that certain course described as South 860-15'-27" West., 28.28 feet in deed to the State of California filed as -Document No. 5520-X in the office of the Registrar of Titles of said County; thence South 360-34.'-33" East., 76.91 feet to the TRUE POINT OF BEGINNING of this description; thence along the southeasterly prolongation of last described course South 360-34'-33" East, 60.80 feet; thence southeasterly, tangent to last described course, along a curve concave northeasterly and having a radius of 224.00 feet., through,,and,angle of 160=50'-52" an arc distance of 65.87 feet to that certain curve described as having a radius of 577.37 feet in Parcel 4 of the deed to the City of West Covina, recorded in Book D1425 Page 787 of Official Records in said first mentioned office; thence northwesterly along last mentioned certain.curve to a curve concave westerly and having a radius of 47.00 feet; said last, mentioned curve being tangent to that certain course herein - before described as having a bearing and length of South 360-34-'-33" East., 76.91 feet at the southeasterly terminus of said last mentioned certain course; thence northerly along said last mentioned curve through an angle of 680-33'-03" an arc distance .of 56.23 feet to the TRUE POINT OF BEGINNING. EXCEPTING THEREFROM that portion lying northwesterly of a line bearing South 530-25-'-27" West and passing through a point in that certain course hereinbefore described as having a bearing and length of South 360-34'-33" East., 60.80 feet; distant along said last mentioned certain course South 360-34'-33" East., 17.00 feet from that certain curve described as having a radius of 88.00 feet in said deed to the State of California. ALSO EXCEPTING AND RESERVING THEREFROM any and all rights of ingress to or egress from the land herein described over and across that certain course hereinbefore described as having a bearing and length of South 360-34'-33" East., 60.80 feet .and that certain curve hereinbefore described as having a radius of 224.00 feet. • PARCEL II. Baldwin's 4th Subdivision of part of the Rancho La Puente, in the City.of West Covina, County of Los Angeles, as shown on map recorded in Book 8 Page 186 of Maps, in the office of the County Recorder of said County, described as follows: Commencing at a point in the northwesterly line of said lot., distant along said northwesterly line, North•41°-15'-27" East., 85.93 feet from the westerly terminus of that certain course described as South 860-1.5'-27" West, 28.28 feet in deed to the State of California filed as Document No. 5520-X in the office of the Registrar of Titles of said County; thence South 360-34'-33" East., 137.71.feet.; thence easterly along a curve concave northerly and having a radius of 224.00 feet through an angle of 590-49'-29" an arc distance of 233.89 feet to the TRUE POINT OF BEGINNING; thence continuing along last mentioned curve through an angle of 370-55'-27" an arci'distance of 148.27 feet to a line parallel with and distant northerly 40.00 feet measured at right angles from that certain course described as South 820-01.'-34" East, 377.35 feet in Parcel 4 of the deed to the City of West Covina, recorded as Document No. 3271 in Book D1425 Pages 787,788 and 789 of Official Records in said first mentioned office; thence easterly along • said parallel line to a point of tangency of said last des- cribed parallel.line with a curve concentric with and distant 40.00 feet northerly measured along -the prolongation of a radial.line from a certain curve having a radius of 537.34 feet, described in said Parcel 4; thence easterly along said concentric curve through an angle .of 00-37'-10" an arc dist- ance of 6.24 feet to aline that bears North 530-40'-26" West; thence South 530-40'-26".East, along last mentioned line, 16.21 feet to aline parallel with and distant 50.00 feet southwest- erly, measured at right angles from the northeasterly line of said lot; thence along last mentioned parallel line South 480-44'-15" East.,.196.36 feet to that certain curve described as having a radius of 497.34 feet in said Parcel 4;'thence westerly along said,certain curve and that certain course described as North 820-Ol'-34" West, 377.35 feet in said Parcel 4 to the TRUE POINT OF BEGINNING. EXCEPTING AND RESERVING THEREFROM any and all rights of ingress to or egress from the land herein described, over and across that certain curve hereinbefore described as having a radius of 224-.00 feet. Baldwin's 4th Subdivision of • part of the Rancho La Puente, in the City of West Covina, County of Los Angeles,.as shown on map recorded in Book 8 Page 186 of Maps, in the office of the County Recorder of said.County described as follows. - Beginning at a point in the northwesterly line of said -lot, distant along said northwesterly line, North 410-15'-27" East., 85.93 feet from the westerly terminus of that certain course -2- described as South 860-15'-27" West., 28.28 feet .in deed to the State of California filed as Document No. 552.0-X in*the office of the Registrar of Titles of said County; thence South 360-34'-33" East, 76.91 feet; thence southwesterly, tangent to last described course along a curve concave northwesterly and having a radius of 47.00 feet, through an angle of 1290-03'-42" • an arc:,distance of 105.87 feet; thence westerly along a reverse curve concave southerly and having a radius of 38.00 feet through an angel of 390-03'-42 an arc distance of 25.91 feet; thence South 530-25'-27" West, 324.85 feet to the beginning of a tangent curve concave easterly and having a radius of 25.00 feet, said last mentioned curve being also tangent to the northeasterly line of the southwesterly 80.00 feet of said lot; thence southerly along said last described curve, through an angle of 330-18'-52" an arc distance of 14.54 feet to the TRUE POINT OF BEGINNING; thence continuing along last mentioned curve through an angle of 470-42'-16" an arc distance of 20.82 feet to that certain course described in Parcel 2 North 30-34'-55" West, 28.28 feet in the deed to the City of West Covina recorded as Document No. 3271 in Book D1425 Pages 787,788 and 789 of Official Records of said County; thence northerly along last mentioned course 20.21 feet to the TRUE POINT OF BEGINNING. Reserving and excepting from parcels one through three:inclus- ive of'said vacation., the permanent easement and right at any' time or from time to time, to construct, maintain., operate, replace, remove and renew sanitary sewers and.storm drains and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, • telegraphic and telephone lines, and for the transportation or distribution of electric energy, water and incidental pur- poses; including access and the right to keep the property free from inflammable materials and wood growth, and otherwise protect the same from all hazards in., upon and over the street or part thereof proposed to be vacated. (c) That:on the llth day of January, 1971, at a regular Council Meeting the said City Council did hold a public hearing to determine whether the said areas above - described should be'vacated as a public street. SECTION 2. It hereby is found, determined., and declared by the City Council of the City of West Covina, after hearing the evidence adduced., that the above -described portion of West Covina Parkway within the City of West Covina is not necessary for present or prospective public street purposes and the general welfare and convenience of the City of West Covina require that the same be vacated. The said portion of West Covina Parkway above -described hereby is vacated as a public street. SECTION 3. The City Clerk shall certify to the adoption of this resolution and cause the same to be recorded with the office of the Recorder of the County of Los Angeles and'to file all other necessary documents in order that this • vacation become effective.
