A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA APPROVING PRECISE PLAN
OF DESIGN NO. 17, REVISION 19 (Sanborn
Theaters).
. The City Council of the City of West Covina does resolve
as follows:
SECTION 1. The City Council does hereby find and
determine that there was filed with the Planning Commission the
application of Sanborn Theaters requesting the approval of a
precise plan of design for the physical development of a parcel
of land commonly known as 2504 East Workman Avenue, as more
particularly described in Precise Plan of Design No. 17, Revision
19, that hearings thereon were duly conducted by the Planning
Commission and the Planning Commission approved the application,
that the matter was appealed by the applicant to the City Council,
and the City Council held a hearing thereon in connection with
Zone Change Application No. 492, and proper and legal notice of
hearing on said zone change was duly given.
SECTION 2. Precise Plan of Design No. 17, Revision
19, is hereby approved pursuant to the provisions of the West
Covina Municipal Code provided that the physical development of
the property included therein shall conform to said plan and each
and all of the conditions of precise plan approval contained in
Resolution No. 2601 adopted by the Planning Commission on August
6, 1975, which resolution is by this reference incorporated
herein except that item No. 7 c is modified to permit the applicant
to post a bond or deposit together with an agreement to provide
isthe street improvements at such time as the remainder of the
street easterly of Citrus is improved.
Except as otherwise expressly provided herein or in
Resolution No. 2601, each and every one of the conditions con-
tained therein shall be fully performed and completed or shall
be secured by bank or cash deposit satisfactory to the Planning
Director before the use or occupancy of the property is commenced
and before a certificate of occupancy is issued. The violation
of any of said conditions shall be grounds for the revocation of
Precise Plan of Design No. 17, Revision 19, by the Planning
Commission or City Council.
SECTION 3. The City Clerk shall certify to the adoption
of this,'resolution.
