Resolution - 5040RESOLUTION NO. 5040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING UNCLASSIFIED USE PERMIT NO. 71, REVISION 5 (as Adopted by City Council Resolution 4919). • WHEREAS, the City Council has proposed certain additional amendments to Unclassified Use Permit No. 71, Revision 5, and after notice and public hearing, has approved certain amendments thereto; NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION 1. The following amendments to Unclassified Use Permit No. 71, Revision 5, as adopted by City Council Resolution No. 4919, are hereby adopted: (a) Section 2 thereof is amended to read: "2. EFFECTIVE DATE Unclassified Use Permit No. 71, Rev. 5 (Amendment) is approved and will become effective when the West Covina Planning Commission finally approves a Master Development Plan as set forth in Condition 5 of this Unclassified Use Permit. Unclassified Use Permit No. 71, as modified by Revisions 1-4 and 6, shall remain operative and in effect until Unclassified Use Permit No. 71, Rev. 5 (Amendment) is effective. This Unclassified Use Permit No. 71, Rev. 5 (Amendment) shall cease to be effective for any purpose on October 1, 1975." • (b) Section 4.1 is added thereto to read: "4.1 If, in the course of any inspection of the landfill site, the City Engineer or his designee observes any con- dition, the continuance of which could lead to a violation of any of the operating conditions of this permit, he shall give written notice of the condition to the on -site manager of the BKK Company. The notice shall contain his recommendations, if any, for corrective action. A copy of the notice shall be delivered to the City Manager." (c) Paragraph (d) of Section 22 thereof is amended to read: "(d) Liquid waste deposited in a Class I site may be ponded during those regular operating hours specified in Condition No. 35. All liquids not deposited in wells shall be spread and mixed with soil and refuse and covered before sundown each day. Covered landfill material that has been in place. more than two (2) days shall not be exposed to permit the disposal of liquids." (d) Paragraph (i) is added to Section 22 to read: "(i) All odorous liquids shall be disposed of in wells. All odorous solids shall be covered by soil and refuse immediately after disposal in order to prevent the escape of odors." SECTION 2. The City Clerk shall certify to the adoption of this resolution.
