A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
West Covina MAKING FINDING ON THE REPORT FOR
THE IMPROVEMENT OF lark Ellen Avenue
( Apt-66 )
WHEREAS, the hearing on the Special Assessment Investigation
Report for the proposed improvement of Ta.rk F,llen Avenue
by the construction of improvements has been conducted by the City
Council of the City ofWgZ C yJ=; and
WHEREAS, the City Council has considered said Investigation
Report as required by Division 4 of the Streets and Highways Code
of the State of California; and
WHEREAS, protests made or filed against this proceeding
represent less than fifty per cent (50%) of the assessable area
of the district proposed to be assessed for said improvement; and
WHEREAS9 the Investigation Report shows that the debt limit-
0 ations provided in said Division 4 will not be exceeded and, there-
fore, the Council desires to proceed with the improvements at this
time;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
RESOLVE AS FOLLOWS:
SECTION 1. That all protests to said report or improvement
heretofore made or filed hereby are overruled and denied.
SECTION 2. That the public interest, convenience, and
necessity require the acquisition and improvement substantially as
set forth in said report forLark ElleanAvee
project is feasible
and the lands to be assessed for said improvement will be able to
carry the burden of such proposed assessment. That the limitation on
the amounts of assessment as prescribed by said division 4 may be dis-
regardedSECTION 3. The City Clerk shall certify to the adoption of
• this resolution, and thenceforth and thereafter the same shall be
in full force and effect.
