Resolution - 3508RESOLUTION NO. 3508 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA APPROVING PRECISE PLAN OF DESIGN NO. 509 (R), (Virgil F. Nelson) The City Council of the City of West Covina does resolve as follows: SECTION 1. The City. Council does hereby find and determine that there was filed with the Review Board the application of Virgil F. Nelson, requesting approval of a precise plan of design for an ice vending machine upon property located at 818 West Cameron Avenue, that a hearing thereon was duly conducted by the Review Board, and that the Review Board granted said application subject to certain conditions; that the matter was appealed to the City Council on its own motion and that the City Council has held a hearing thereon, and that proper and legal notice of said hearings was duly given. SECTION 2. Said precise plan of design is hereby approved, subject to the following conditions, violation of any of which shall be grounds for revocation thereof: 1. Comply to all provisions of the C-1 Zone and Study Plan "A" dated September 26, 1966. 2. A common driveway easement between Cameron Avenue and Glendora Avenue shall be approved by the Assistant City Attorney between the subject property and the two properties to the south (Dog House, Precise Plan No.476R, and Nasch, Precise Plan No.497R) before issuance of a building permit. 3. A 6 foot block wall shall be required along the entire western property line 42 inches high'in front yard -space, and in the event the property next door develops as commercial, the block wall shall not be required and the city will accept in lieu of block wall at this time a bond or suitable alternate thereto. . 4. The operation shall be maintained as not to produce excessive noise. 5. A 4 inch curb shall separate the landscaping from the driveway. 6. No signs are given approval by this precise plan. All signs must comply with the provisions of the C-1 Zone. 7. Engineering Department requirements: a. Applicant to comply with all conditions contained in Planning Commission Resolution No. 567. In the event a driveway opening is made to the adjacent Gulf Oil property, grading and drainage plan -shall be submitted showing that this new drainage condi- tion is handled. b. Sidewalks shall be constructed along Cameron Avenue. c. Adequate provision shall be made for disposal of surface drainage leaving the property. A holdharmless letter permitting it should be furnished from the downstream owner. d. Private alley or driveway improvements shall be constructed to the City of West Covina standards. 8. Foundation (skirt) area to be covered to the satisfac- tion of the staff. 9. In consideration of West Covina Code Sections 9211.3 and 922004 we interpret the front yard setback to be 22 1/2 feet. 10. Ingress and egress to any adjacent property shall have the concurrence of the property owner to the satisfaction of the City Attorney. In the event that the Gulf Oil station requests an administra- tive change to relocate parking spaces to allow access across their property, it shall be approved. 11. Two parking spaces on the precise plan shall be located administratively by the staff to minimize operating interference. 12. Existing curb cut may remain with no requirement for a street tree. 13. Landscaping shall be provided in front yard space for 22 1/2 feet except that stairway and sidewalk to front end of.ice building will be permitted. 14. An ice dispensing structure is an allowable use in Zone C-1 under the section naming vending machines. 15. The Planning Commission would recommend no limitations (such as size, weight, etc.) on the structure used for a vending machine in Zone C-1. 16. The structure dispensing ice, as proposed on Precise Plan No. 509 (R), does fall within the recommendations of 1 and 2 above. 17. A 'building used for storage of materials to be used at other locations besides the property under consideration does not fall within the allowable uses in Zone C-1. 18. The total proposed development of Precise Plan No. 509 (R) is not allowable within Zone C-1 by the interpretations of item 4 above. 19. The total proposed development of Precise Plan No. 509 (R) is not allowable within Zone C-1 under Section 9211.0 (Similar establishments catering directly to consumers.). 20. The total proposed development of Precise Plan No. 509 (R) is allowable within Zone C-1 under Section 9211.0 (Similar establishments catering directly to consumers.) if storage of materials is for use only on the subject property. SECTION 3. The City Clerk shall certify to the adoption • of this resolution and shall transmit a certified copy to said applicant. 1966.
