RESOLUTION NO. 3438
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA ORDERING THE VACATION OF A. CERTAIN
PORTION OF MERCED AVENUE AND MERCED PLACE
AND RESERVING AND EXCEPTING IN FAVOR OF THE CITY
OF WEST COVINA CERTAIN RIGHTS AND EASEMENTS
LOCATED THEREIN FOR PUBLIC UTILITY AND OTHER
PURPOSES.
The City Council of the City of West Covina;does resolve as
follows:
SECTION 1. The City Council of the City of West Covina does
hereby find, determine, and declare as follows:
(a) That on the 27th day of June ,
1966 , at a regular meeting of said Council, Resolution No. 3396
was duly adopted by a vote of said Council setting the time for hearing
on the proposed vacation of a certain portion of MERCED AVENUE AND MERGED
located within the City of West Covina; piiieE
(b) That said area proposed to be vacated is more
particularly described as follows:
That portion of Merced Avenue (80 feet wide) in the City of West Covina,
County of Los Angeles, State of California as shown on the map of
Tract 21287 recorded in Book 570, Pages 12-14 of maps in the office of
the County Recorder of said County described as follows:
Beginning at a point in the North line of Lot 6 of said Tract, distant
North 890-19'-50" West 47.98 feet from the Northeast corner of said
Lot 6, said point being the beginning of a tangent curve concave to
the Northeast and having a radius of 540 feet, thence Northwesterly
along said curve through a central angle of 241-33'-32" an arc length
of 231.46 feet to a point of reverse curve, said reverse curve being
concave to the South aqd having a radius of 25 feet thence Southwesterly
along said curve through a central angle of 720-28'-19" an arc length
of 31.62 feet to a point of reverse curve, said reverse curve being
concave to the Northwest and having a radius of 130 feet, thence south-
westerly along said curve through a central angle of 471-54'-47" an
arc length of 108.71 feet to the point of tangency with the South line
of Merced Avenue 80 feet wide, thence South 890-19'-50" East 349.86
feet to the point of beginning.
Excepting that portion lying Northerly of the old centerline of Merced
Avenue 80 feet wide as shown on said Tract 21287.
Reserving and excepting from said vacation the permanent easement and
right at any time, or from time to time, to construct, maintain, oper-
ate, replace, remove and renew sanitary sewers and appurtenant struc-
tures thereof and to construct, maintain, operate, replace, remove,
renew and enlarge lines of pipe, conduits, cables, wires, poles and
other convenient structures, equipment and fixtures for the operation
of gas pipe lines, telegraphic and telephone lines, and for the trans-
portation or distribution of electric energy and water, including access
and the right to keep the property free from inflammable materials and
wood growth and otherwise protect the same from all hazards in, upon
and over the street or part thereof to be vacated.

(c) That on the 25th day of July .
at a. regular Council meeting the said City Council did hold
hearing to determine whether the said area above -described
be vacated as a public street.

• SECTION 2. It hereby is found, determined, and declared by
the City Council of the City of West Covina, after hearing the evidence
adduced,- that the above -described portion of Merced Avenue and Merced Place
within the City of West Covina is not necessary for present or pros-
pective public street purposes and the general welfare and convenience
of the Cit� �+f%9-ovdM require that the same be vacated. The said
portion of erce PP ace above -described hereby is vacated as a
public street, excepting and reserving to the City the rights and ease-
ments, as above -described.
SECTION 3. The City Clerk shall certify to the adoption of
this resolution and cause the same to be recorded with the office of
the Recorder of the County of Los Angeles and to file all other neces-
sary documents in.order that thisvacation become effective.
