Resolution - 3414RESOLUTION NO. 3414 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA FINDING AND DECLARING THAT A MAJORITY PROTEST HAS NOT BEEN MADE AND CALLING A SPECIAL ELECTION TO BE HELD ON THE THIRTEENTH DAY OF SEPTEMBER, 1966 PERTAINING TO THE ANNEXATION OF WEST COVINA SOUTHERLY ANNEXATION DISTRICT NO. 192 TO THE CITY OF WEST COVINA. WHEREAS, by Resolution No. 3379' the City Council of the City of West Covina declared its intention to call a special election in certain inhabited territory contiguous to said City proposed to be annexed to said City, for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to said city, and contained a notice of the time and place for hearing property owners' protests as required by Section 35117 of the Government Code; and WHEREAS, a copy of said resolution was published and mailed as required by law; and WHEREAS, more than ten days have passed after June 27, 1966, the time set by said resolution for hearing on protests to the proposed annexation, and a majority protest has not been made as prescribed in Section 35121 of the Government Code of the State of California, and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars; NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council does hereby find and declare that a majority protest has not been made against said Southerly Annexa- tion District No. 192 to the City of West Covina. The City Council does not elect to make any change in the boundaries thereof. SECTION 2. A special election hereby is called to be held on the 13th day of September, 1966, in the territory hereinafter des- cribed and proposed to be annexed to the City of West Covina, for the purpose of submitting to the electors residing in said territory the question whether or not such territory shall be annexed to and incorpo- rated in said City of West Covina. Said territory is described as follows: Beginning at the intersection of the northerly and westerly boundary lines of the City of West Covina as same existed on September 19, 1963 with the certification of Southerly Annexation District No. 181 to the City of West Covina. (Ordinance No. 815), said intersection being the intersection of southerly boundary of E. J. Baldwin's Fifth Subdivision of a portion of Rancho La Puente in the County of Los Angeles, State of California, as per map thereof recorded in Book 12, Pages 134 and 135 of Maps, in the office of the County Recorder of said County, with the east line of Pass and Covina Road, 60 feet wide, as • er map of Tract No. 13875, recorded in Book 284, Pages 1 and 42 of Maps in the Records of said County; thence westerly along the westerly prolongation of said southerly boundary to intersection with the centerline of said Pass and Covina Road, 60 feet wide, which last intersection is the True Point of Beginning; thence northwesterly along said centerline to the southerly terminus of that certain course having a bearing of north 0' 151 20" east in the centerline of Pass and Covina Road as last mentioned centerline is shown on said map of last mentioned tract; thence northerly along last mentioned centerline to the westerly prolongation of the centerline of Future Street now Maplegrove Street, 60 feet wide, as shown on said map • of last mentioned tract; thence easterly along said center- line of Maplegrove Street to intersection with the westerly line of Tract No. 19056 as per map thereof recorded in Book 495, pages 18 and 20 inclusive, of Maps in the records of said County; thence easterly along centerline of Maple - grove Street as shown on said map of the last mentioned tract, north 750 361 23" east 306.40 feet to intersection with the centerline of Lark Ellen Avenue as shown on said map of last mentioned tract; thence northerly an are distance of 138.42 feet along the centerline of said Lark Ellen Avenue which is a nontangent curve concave easterly having a radius of 600 feet, through a delta of 13° 131 05" to intersection with the boundary of said Tract No. 19056 being a nontangent line bearing north 57' 081 09" east; thence along last mentioned line easterly 47.67 feet to intersect with the most northerly corner of Lot 4 of said Tract No. 19056; thence along the northerly boundary of said Tract No. 19056 to the most northeasterly point of said Tract No. 19056 which at this point adjoins Tract No. 29000, which last mentioned tract is shown on map recorded in Map Book 712, pages 74 through 76 inclusive of Maps, in the records of said county; thence easterly along the boundary of said Tract No. 29000 and following the same in all its various courses to the point on last mentioned boundary which adjoins Tract No. 26809 which • last mentioned tract is shown on map recorded in Book 719, Pages 1 and 2 of Maps, in the records of said County, last mentioned point being also the most easterly point of Lot 40 of said Tract No. 29000; thence south- easterly along the boundary of said Tract No. 26809 to intersection with the northerly boundary of the afore- mentioned Southerly Annexation District No. 181 to the City of West Covina at the most southeasterly point of said Tract No. 26809; thence westerly along said northerly boundary of said Southerly Annexation District No. 181 which is also the southerly boundary of said E. J. Baldwin's Fifth Subdivision, to the Point of Beginning. SECTION 3. TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened at 7:00 o'clock a.m. of the day herein fixed for the holding of said election and shall be kept open until 7:00 o'clock p.m. of the same day, when the polls shall be closed. SECTION 4. BALLOTS. Upon the ballots to be used at said election there shall be printed the words: SHALL SOUTHERLY ANNEXATION DISTRICT NO, 192 BE ANNEXED TO THE CITY OF WEST COVINA? Opposite these words there shall be printed the words "Yes" and "No", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (+) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of West -2 - Covina; and if an elector shall stamp a cross (+) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. In all particulars not herein recited said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. SECTION 5. (a) For the purpose of said election there hereby is established in the territory described herein one voting pre- cinct, which shall include all of said territory. The polling place of said election precinct.and the two judges and one inspector to be officers of election and constitute the board of election for such election precinct shall be designated by the City Council prior to publication of notice of election. (b) For their services in connection with said election, said inspector shall receive $18.00 and said judges $15.00 each; and the person in possession of the polling place named herein shall receive for the use of such premises in connection with said election the sum of $15.00. SECTION 6. The City Clerk shall publish a notice of said special election as required by said Annexation Act of 1913, at least once a week for the four weeks prior to the date of the election, in the La Puente Valley Journal, a newspaper of general circulation, printed and published outside of the City of West Covina, but in the County of Los Angeles, California. SECTION 7.
