Resolution - 3396RESOLUTION NO. 3396 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA DECLARING ITS INTENTION TO VACATE. A CERTAIN PORTION OF MERCED AVENUE AND MERCED PLACE SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN RIGHTS.':AND EASEMENTS •The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council of the City of West Covina, upon recommendation of the Planning Commission, does hereby declare its intention to vacate a certain portion of Merced Avenue and Merced Place in the City of West Covina as shown on a map.or plan on file in the office of the City Clerk to which reference is made for further particulars, described as follows: That portion of Merced Avenue (80 feet wide) in the City of West Covina, County of Los Angeles, State of California as shown on the map of Tract 21287 recorded in Book 570, Pages 12-14 of maps in the office of the County Recorder of said County described as follows: Beginning at a point in the North line of Lot 6 of said Tract, distant North 89°-19'-50" West 47.98 feet from the Northeast corner of said Lot 6, said point being the beginning of a tangent curve concave to the Northeast and having a radius of 540 feet, thence Northwesterly along said curve through a central angle of 240-33'-32" an arc length of 231.46 feet to a point of reverse curve, said reverse curve being concave to the South and having a radius of 25 feet thence Southwesterly along said curve through a central angle of 720-28'-19" an arc length of 31.62 feet to a point of reverse curve, said reverse curve being concave to the Northwest and having a radius of 130 feet, thence southwesterly • long said curve through a central angle of 47°-54'-47" an arc length of 108.71 feet to the point of tangency with the South line of Merced Avenue 80 feet wide, thence South 890-19'-50" East 349.86 feet to the point of beginning. Excepting that portion lying Northerly of the old centerline of Merced Avenue 80 feet wide as shown rn said Tract 21287. Reserving and excepting from said vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe'lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy and water, including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect the same from all hazards in, upon and over the street or part thereof to be vacated. The City Council does hereby determine that the public con``-- venience and necessity require the reservation of the rights, easements and rights of way enumerated above„ These proceedings for the vacation of said portion of Merced Avenue_ and _Merced Place are taken subject to such reservations and exceptions. SECTION 2. The City Council of the City of West Covina does •hereby elect to proceed to vacate the said portion of said street under r the provisions of Part 3, Division 9 of the Streets and.Highways Code of the State of California. - 1 - SECTION 3. The hour of 8:00 o'clock P.M. on Monday the 25thday of July , 19 66, is hereby fixed as the time and the Council Chamber in the City Hall at 1444 W. Garvey Avenue,.West Covina, California, is hereby fixed as the place for hearing all persons interested in or objecting to the proposed vacation of said portion of said street. SECTION 4. Notices of Street Vacation shall be posted by the Street Superintendent in the manner prescribed by Section 8322 of the • Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published within fifteen days of its adoption in one regular issue of the West Covina Tribune a newspaper of general circulation, printed, published and circulated in the City of West Covina.
