Resolution - 3393RESOLUTION NO. 3393 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN LIGHTING FIXTURES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES IN THE CITY OF WEST COVINA TO BE INSTALLED WHERE NOT ALREADY INSTALLED AND MAINTAINED, AND ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID FIXTURES INSTALLED AND/OR TO BE INSTALLED FOR A PERIOD OF FIVE (5) YEARS, COMMENCING JULY 1, 1966, AND APPOINTING A TIME AND PLACE FOR HEARING PROTESTS IN RELATION THERETO." THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the public interest and convenience require, and that it is the intention of the City Council of the City of West Covina, California, to order the certain • fixtures and appliances on portions of streets, avenues, places and drives within said City, all as shown on Diagram and Plan No. LAD 66-71, on file in the office of the City Clerk, to be installed in those locations where necessary and maintained and electric current to be furnished for lighting said fixtures and appliances installed and/or to be installed for a period of five (5) years commencing July 1, 1966. All of the work and improvement above specified shall be done in accordance with the specifications and plans therefor referred to in the report of the City Engineer dated June 24, 1966, on'file in the office of the City Clerk and which is hereby referred to and by this reference incorporated herein and made a part hereof. • SECTION 2. That the City Treasurer establish a special fund known as "Street Lighting Installation, Maintenance and Electric Current Fund, Street Lighting Assessment District No. LAD 66-71,J".`that said City Treasurer shall place in said special fund all monies collected by the Tax Collector pursuant to the provisions of Section 6 of this resolution, as soon as • said monies have been transferred to said City Treasurer. Payments shall be made out of said special fund only for the purposes provided for in this resolution. To expedite the making of this improvement, the City Council, -hall transfer into said special fund, out of any money in the general fund, such sums as it may deem necessary, and the sums so transferred shall be deemed a loan to such special fund, and shall be repaid out of the prodeeds of the assessments provided for in this resolution. SECTION 3. That those parcels shown in green brackets and asterisks, from pages 246 to 1076, on the City of West Covina, • Lighting Assessment Rolls, LAD 66-71, be designated Area 2; That those parcels constituting Area 2, be shown on the new City of West Covina Lighting Assessment Rolls, LAD 66-71, for the year 1966-67, the same as now carried on .. LAD 1965-67; That at the conclusion of the period, 1966-67, LAD 1965-67,said Area 2, shall be carried for the years 1967-71, on the same basis as all other parcels in LAD 1966-71. That those parcels now in a County of Los Angeles Street Lighting District, be carried as a nil assessment, until the end of the current year. Then they shall bear an assessment for the four remaining years, on the same basis as all other parcels in LAD 1966-71; 0 is U SECTION 4. That said contemplated work and improvement, in the opinion of the City Council, is of more than local or ordinary benefit, and said Council hereby makes the expense of said work and improvement chargeable upon a district, which district said Council hereby declares to be the district benefited by said work and improvement, and to be assessed to pay the cost and expense thereof, which said district is all of the City of Vilest Covina as shown on Diagram and Plan No. LAD 66-71, on file in the office of the City Clerk, on which map the assessment district is indicated, and to which said map reference is hereby made for a complete and detailed description ofsaid district. The said diagram so on file shall govern for all details as to the extent of said assessment district. SECTION 5. Any lots or parcels of land known as public property, as the same is defined in Section 18014, Part 1, Division 14, Streets and Highways Code, as amended, (Street Lighting Act of 1919), hereinafter referred to, which are included in the said assessment district, shall be omitted and exempt from the assessment to be made to cover the costs and expenses of said contemplated improvement. SECTION 6. The improvement contemplated by this Resolution of Intention shall be done under the provisions of the "Street Lighting Act of 1919" (now Part 1 of Division 14 of the Streets and Highways Code of the State of California), as amended, and under the alternative procedure for installment assessments provided for in Chapter 8 of said "Street Lighting 0 Act of 1919". SECTION 7. That Monday, the 25th day of July, 1966, at the hour of 8:00 o'clock P.M. (California Daylight Saving • Time) of said day be, and the same is hereby appointed as the time, and the Council Chamber in the City Hall, 1444 West Garvey of said City of West Covina, California, is hereby appointed • as the place for hearing protests, in reference to said w improvement. SECTION 8. That the City Clerk is hereby authorized, designated and directed to give notice of said hearing in time, form and manner as required by law. SECTION 9. That the WEST COVINA TRIBUNE, a weekly newspaper of general circulation, published and circulated within the City of West Covina, California, is hereby designated as the newspaper in which such notice shall be published. SECTION 10. That this resolution shall take effect immediately; and the City Clerk shall certify to the passage and adoption of this resolution, shall cause the original of the same to be entered among the original resolutions of the City Council of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council.of said City in the minutes of the meeting at which the same is passed and adopted.
