Resolution - 2747I RESOLUTION NO. 2747 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC USE FOR SANITARY SEWER PURPOSES. The City Council of the City of West Covina does resolve as follows: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acqui- sition of an easement and right of way in, over and under the herein- after described real property for sanitary sewer line and appurtenant purposes. That the location of the land for said easement and right of way has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council hereby finds, determines and declares that, in order to acquire said easement and right of way and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the right of way by the City of West Covina in, over and under that certain real property hereinafter described, and the City Council hereby declares it is the intention of the City of West Covina to acquire in its name said right of way in, over and under the hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of an easement and right of way in, over and under which is required by the public interest, convenience and necessity for the purposes set forth in Sections 1 and 2 hereof, is described as follows: That portion of the South one-half of Lot 8, Block 22 of the Phillips Tract in the City of West Covina, County of Los Angeles, State of California, as per map recorded in Book 9 Pages 3 and 4 of Miscellaneous Records in the office of the County Recorder of said County, together with the right of ingress and egress, construction, repairing, replacing, and maintaining a sewer main and the appurtenances therefortwithin a strip of land 8 feet wide lying 4 feet on each side of the following described line: Beginning at a point in the southerly line of said Lot, which is distant North 890 06, 48" West thereon 196.00 feet from the southeasterly corner of said lot; thence parallel.with the easterly line of said lot, North 0° 09' 00" East 250 feet, to the true point of beginning; thence continuing North 00 09' 00" East 47.47 feet, to the northerly line of the South one-half of said Lot. SECTION 4. That the City Attorney of the City of West •Covina and Burke, Williams & Sorensen hereby are authorized, empowered, and directed to prepare, institute and prosecute in the name of the City of West Covina such proceedings in the proper court having juris- diction thereof as are necessary for the condemnation of the said ease- ment and right of way described herein. -1- I EI 0 Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use and occupancy of said property, and the deposit of any money by the City necessary therefor, is hereby approved and authorized. SECTION 5. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this23rd day of September , 1963.
