Resolution - 2707s L • if I RESOLUTION NO. 2707 A RESOLUTION OF THE CITY COUNCIL OF•T vCITY OF WEST COVINA. DECLARING ITS INTENTION ', `IMPROVE LARKWOOD, THACKERY, AND OTHER STREET$ AND RIGHTS OF WAY BY THE CONSTRUCTION OF A SANITARY SEWER SYSTEM IN THE CITY OF WEST COVINA AND IN A PORTION OF THE UNINCORPORATED AREA OF LOS ANGELES COUNTY, DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR, DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED UPON A DISTRICT (A'11-62-2) WHEREAS, the Health Officer of the County of Los Angeles, acting as the Health Officer of said County and as the Health Officer of the City of West Covina in writing by letter dated December 13, 1962, has recommended to the City Council of the City of West Covina that sanitary sewers be installed and constructed in Larkwood Street, Thackery Street, and other streets and rights of way within the proposed district A►11-62-2 in the City of West Covina and in an unincorporated portion of the County of Los Angeles; and WHEREAS, said recommendation of said Health Officer has been presented to and spread upon the minutes of the City Council on June 10 , 1963; and WHEREAS, said City Council by Resolution No, 2647 adopted June 10 1963, by a four -fifths (4/5) vote of said City Council, found and determined that the installation and construction of such sanitary sewers is necessary as a health measure; and WHEREAS, a portion of the work proposed to be done is outside of the City of West Covina and is in an unincorporated portion of the County of Los Angeles. A resolution approving the doing of such work has been adopted by the Board of Supervisors of the County of Los Angeles; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES RESOLVE AS FOLL61S : SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of West Covina to order the following work to be done, ' to wit: ' The improvement of the hereinafter designated streets by the•installation and construction of a sanitary sewer system, the excavation, backfilling, and the resurfacing of portions of streets as necessitated thereby and all work appurtenant thereto in: • -2- Cajon Circle between Cajon Avenue and the westerly right of way line of Cajon Circle; An easement 10.25 feet in width at right angle to Azusa Avenue and between the westerly right of way line of Cajon Circle and the easterly right of way line of Azusa Avenue, the center line of said easement being the prolongation of the center line of Cajon Circle; A portion of Azusa Avenue lying within the prolongation of the ' northerly and southerly lines of the above -described easement and between the easterly right of way line of Azusa Avenue and the westerly curb line of Azusa Avenue; Merced Avenue between the center line of Michelle Street and Hollenbeck Street; Glenview Road between a point 5 feet south of the center line of Vine Avenue and a point in Glenview Road 110 feet + north of the center line of Alaska Street; Thackery Street between a point 5 feet west of the center line of Glenview Road and the easterly terminus of Thackery Street in Tract No. 17601; Alaska Street between the center line of Fleetwell Avenue and a point in Alaska Street 5 feet west of the center line of Glenview Road; Rexwood Street between the center line of Sunset Avenue and the westerly line of Broadmoor Drive; Broadmoor Drive between the northerly line of Rexwood Street and ' a point in Broadmoor Drive 340 feet + south of the center line of Rexwood Street; Yarnell Street between the prolongation of the northwesterly line of Lot 4, Tract No. 19064 and the prolongation of the southeasterly line of Lot 2 of said tract. Rexwood Street between the southeasterly line of Meeker Avenue and the termination of Rexwood Street in Tract No. 19064; Hillward Avenue between the center line of Cameron Avenue and the southerly right of way line of Thackery Avenue; Del Cerro Avenue between the center line of Lolita Street and the - center line of Del Cerro Drive; Del Cerro Drive between the northerly line of Del Cerro Avenue and the southerly termination of Del Cerro Drive in Tract No. 18434; Thackery Street between Hollenbeck Street and a point in Thackery Street 743 feet + westerly of the center line of Hollenbeck Street; Rowland Avenue between the existing manhole in Rowland Avenue 53 . feet + west of the center line of Homerest Avenue and the prolong- ation —of the easterly line of Lot 9, Tract No. 18190; ' Larkwood Street between the center line of Glenn Alan Avenue and the center line of Azusa Avenue; -3- r Cajon Avenue between 5 feet north of the center line of Larkwood Street and the southerly termination of Cajon Avenue in Tract No. 18221; Donna Beth Avenue between 5 feet north of the center line of Larkwood Street and the southerly termination of Donna Beth Avenue in Tract No. 21267; ' Terri Ann Drive between Larkwood Street and the in Tract No. 21267; 5 feet north of the center line of southerly termination of Terri Ann Drive Barranca Street between a point in Barranca Street 606 feet + north of the north right of way line of Cortez Street and the south right of way line of Cortez Street; Glenn Alan Avenue between 5 feet north of the center line of Larkwood Street and the southerly termination of Glenn Alan Avenue in Tract No. 21267; Cajon Avenue between the center line of Cameron Avenue and the southerly termination of Cajon Avenue in Tract No. 20121; Donna Beth Avenue between the center line of Cameron Avenue and the southerly termination of Donna Beth Avenue in Tract No. 20935; Thackery Avenue between the westerly right of way line Avenue and a point in Thackery Avenue 115 feet + east center line of Hillward Avenue. of Hillward of the -4- 6 That the public interest and convenience require, and it is the intention of the City Council of the City of West Covina to order• the acquisition of capacity rights in sewer ' trunk lines as follows in connection with the hereinabove ' described sewer construction work: That certain sewer trunk line located in Lark Ellen Avenue and Vine Avenue between Cameron Avenue and Thackery Street in the City of West Covina; all as shown on Plan No. A111-62-2-A, which said plan hereby is approved and adopted. That all of the foregoing work shall be done in accordance with the profile and improvement plan, No. SP-263, and any supplemental drawings mentioned thereon, which said profile and improvement plan was adopted by Resolution No. 2649 of the City Council on June 10 , 1963, and is on file in the office of the City Engineer of the City of West Covina, and in accordance with specification entitled At11-62-2 which was adopted by Resolution No. 2649 of the City Council on June 10 1963. SECTION 2. The estimated cost of this improvement is $154,948.83. That said proposed work or improvement, in the opinion of the City Council of the City of West Covina, is of more than local or ordinary public benefit, and the Council hereby proposes that the district, consisting of noncontiguous areas, in the City of West Covina to be benefited by said work or improvement and to be assessed to pay the cost and expenses thereof is shown on that certain plan or . map, No. A111-62-2, indicating the exterior boundary thereof, approved by Resolution No. 2648 of the City Council on June 10 , 1963, and on file in the office of the City Engineer. Said plan or map hereby is referred to and shall govern for all details as to the extent of -5- the assessment district. The assessment district includes, in general, the lots and parcels of land abutting upon or contiguous to the hereinabove described streets, but reference hereby is made to said plan or map for all details as to the ' extent of said assessment district and for any variation between the last mentioned general description and the extent of the assessment district as shown on the plan or map. All public streets or alleys, or portions thereof, hereby are excepted from said district. SECTION 3. That serial bonds, bearing interest at the rate of 5% per annum, shall be issued to represent each assess- ment of $50.00 or more remaining unpaid for thirty (30) days after the date of the recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1st following their date. Payments on the principal or unpaid assessments and interest shall be made by property owners to ' the City Treasurer, and the sums shall be disbursed by him or as provided in the Improvement Act of 1911 hereinafter referred to. SECTION 4. Notice hereby is given that on August 12 , 1953, at 8:00 p. m. in the Council Chamber of said City in the City Hall located at 1444 West Garvey Avenue, West Covina, California, any and all persons having any objection to the proposed work or improvement, to the extent of the assessment district, or both, may appear before the City Council and show cause why the proposed work or improvement should not be carried out in accordance with this Resolution of Intention. Protests • must be in writing, must contain a description of the'property sufficient to identify it, and must be delivered to the City Clerk not later than the hour set for hearing. -6- C • d SECTION 5. The Superintendent of Streets immediately shall cause notice of the passage of this Resolution of Intention to be posted conspicuously along the line of the contemplated work or improvement and along all the open streets within said district, in the manner and form prescirbed by law. The City Clerk hereby is directed to mail notices, in the manner and form prescribed by law, of the adoption of this resolution to all persons owning real property in the hereinbefore described assessment district, whose names and addresses appear on the last equalized assessment roll for City taxes or as known to the City Clerk. SECTION 6. The City Council of the City of West Covina, in making the improvement and in"doing the work prescribed herein, elects to proceed under and in accordance with the provisions of the Improvement Act of 1911, being Division 7 of the Streets and Highways Code of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the "West Covina Tribune," a newspaper published and circulated in the City of West Covina, the first of which publications shall be not less than ten (10) days prior to August 12 , 1963, the date of said hearing, and which hearing shall be not less than fifteen (15), nor more than sixty (60) days after the date of adoption of this resolution. SECTION 8. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
